He wrote that the law is invalid because it violates the Constitution. \u201cpermits (and in some cases demands)\u201d It is possible for non-experts not to make the decisions which, \u201cdue to lack of education, experience, or expertise, they should not be authorized or capable of making.\u201d<\/p>\n<p>This definition is for \u201clikelihood to result in serious harm,\u201d The law was based on similar mental health laws that allow for voluntary hospitalization. That law, however, requires that physicians determine the likelihood and severity of harm. \u201cgreat majority\u201d Referrals for red-flag law would be made by non-experts, lawyers, school administrators, and family members. The matter will be decided by \u201clay people,\u201d The ruling is applicable.<\/p>\n<p>The court ruled that red flag laws must be able to provide expert medical advice in order for them to be legal.<\/p>\n<p>Daniel Strollo was the New York attorney who fought against the law. <a href=\"https:\/\/twitter.com\/DanielStrollo\/status\/1609003714861318145\" target=\"_blank\" rel=\"noreferrer noopener\">tweeted<\/a> He was \u201cvery happy with this result\u201d It created a \u201cvery quick and easy mechanism to deprive somebody of their fundamental Second Amendment rights,\u201d <a href=\"https:\/\/13wham.com\/news\/local\/state-supreme-court-judge-in-rochester-rules-nys-red-flag-law-unconstitutional-thomas-moran-dan-strollo-erpo-payton-gendron-buffalo-tops-shooting\" target=\"_blank\" rel=\"noreferrer noopener\">according to<\/a> WHAM local outlet<\/p>\n<p>\u201cYou have people who are essentially not medical professionals expressing medical opinions that result in the deprivation of rights,\u201d Strollo said. \u201cAnd you have a procedure that essentially allows somebody to lose those rights without ever having gone in front of a judge.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><\/figure>\n<p>The \u201cred flag\u201d Law is a signature gun control measure that has been enacted in one form or another by at least 19 states. <a href=\"https:\/\/www.wsj.com\/articles\/gun-law-allowing-police-to-seize-weapons-from-potential-shooters-often-isnt-used-11636984981\" target=\"_blank\" rel=\"noreferrer noopener\">reported by<\/a> Wall Street Journal<\/p>\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>New York\u2019s red flag law has been ruled unconstitutional, knocking down a key gun control measure as the state pushes revamped gun laws Through the courts.
