According to <a href=\"https:\/\/apnews.com\/article\/us-supreme-court-politics-united-states-government-donald-trump-immigration-0494c30834fad66ce9c6057ea1605d89\" target=\"_blank\" rel=\"noopener\">The Associated Press<\/a>, an order from Chief Justice John Roberts stayed a lower court\u2019s ruling, which justices extended to give the court time to consider both sides\u2019 arguments.<\/p>\n<p>Former President Donald Trump used the statute to give commanders-in chief the power to close down immigration in an emergency to prevent communicable disease outbreaks. The lawsuit was filed by families seeking asylum. Judge Emmett Sullivan, U.S. District Court, Washington, D.C., ordered the Biden administration&#8217;s lifting of Title 42 by Wednesday.<\/p>\n<p>In his November ruling, Sullivan stated that Title 42 is used to prevent migrants from entering the United States seeking asylum. \u201carbitrary\u201d The law is used.<\/p>\n<p>\u201cIt is unreasonable for the CDC to assume that it can ignore the consequences of any actions it chooses to take in the pursuit of fulfilling its goals, particularly when those actions included the extraordinary decision to suspend the codified procedural and substantive rights of non-citizens seeking safe harbor,\u201d He\u00a0<a href=\"https:\/\/www.aclu.org\/sites\/default\/files\/field_document\/opinion_-_huisha-huisha_v._mayorkas.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a>.<\/p>\n<p>According to The Associated Press, immigration advocates sued to end Title 42, arguing that the policy is outdated \u2014 as COVID treatments have improved \u2014 and that it \u201cgoes against American and international obligations to people fleeing to the U.S. to escape persecution.\u201d<\/p>\n<p>Federal officials stated that lifting restrictions would lead to \u201cdisruption and a temporary increase in unlawful border crossings.\u201d However, they still asked the nation\u2019s highest court to reject the request from 19 Republican state attorneys general to maintain the policy.<\/p>\n<p>Leaders at the border have been anticipating an influx from immigrants for some time. Oscar Leeser (Democratic mayor of El Paso Texas) declared a state-of-emergency on Saturday, in anticipation of Title 42&#8217;s end. \u201cOur asylum seekers are not safe,\u201d The official\u00a0<a href=\"https:\/\/nypost.com\/2022\/12\/17\/el-paso-mayor-oscar-leeser-declares-state-of-emergency-ahead-of-title-42-lifting\/\" target=\"_blank\" rel=\"noopener\">said<\/a>\u00a0at a press conference. \u201cWe have hundreds and hundreds on the street and that\u2019s not the way we treat our people.\u201d<\/p>\n<p>In the past four months, more than 80,000 migrants arrived in El Paso. There are currently 678,000 residents in the city. Winter nights can be below freezing in El Paso. Leeser stated that the possibility of temporarily housing migrants at a nearby base military was not ruled out, adding that officials are examining other options with state and federal officials.<\/p>\n<p>The Department of Homeland Security has previously stated that it would continue to enforce Title 42 until this policy is ended.
