Republicans negotiated a clause repealing the Department of Defense\u2019s COVID vaccine mandate for military members, in part building solid bipartisan support for the legislation approved by Congress earlier this month.<\/p>\n<p>Biden put out a <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/12\/23\/statement-by-the-president-on-h-r-7776-the-james-m-inhofe-national-defense-authorization-act-for-fiscal-year-2023\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> on Friday announcing the NDAA\u2019s signing. The president approved the bill despite the White House\u2019s opposition to several of its elements, including the removal of the vaccine mandate.<\/p>\n<p>The White House noted in Biden\u2019s statement that \u201ccertain provisions of the Act raise concerns.\u201d The repeal of the vaccine mandate was unmentioned. Instead, the White House focused on aspects of the act that Biden said placed concerning or unconstitutional restrictions on the president\u2019s authority. Several sections mentioned blocked funding for the White House to transport Guantanamo Bay detainees to other countries or the United States to stand trial.<\/p>\n<p>\u201cSection 1033 of the Act continues to bar the use of funds appropriated to the Department of Defense to transfer Guant\u00e1namo Bay detainees to the custody or effective control of certain foreign countries. Section 1031 of the Act likewise would continue to prohibit the use of such funds to transfer certain Guant\u00e1namo Bay detainees into the United States,\u201d Biden said.<\/p>\n<p>\u201cIt is the longstanding position of the executive branch that these provisions unduly impair the ability of the executive branch to determine when and where to prosecute Guant\u00e1namo Bay detainees and where to send them upon release,\u201d he added.<\/p>\n<p>Republicans have criticized Secretary of Defense Lloyd Austin since his August 2021 decision to make the COVID vaccine mandatory for military service members. Austin and the Biden administration continued to claim the mandate\u2019s necessity to military readiness as lawmakers haggled over the NDAA.<\/p>\n<p>\u201cWe lost a million people to this virus,\u201d Austin <a href=\"https:\/\/fortune.com\/2022\/12\/04\/covid-19-vaccine-mandate-military-national-guard-lloyd-austin-pentagon-will-stay-in-place\/\" target=\"_blank\" rel=\"noopener\">said<\/a> earlier this month. \u201cA million people died in the United States of America. We lost hundreds in DOD. So this mandate has kept people healthy.\u201d<\/p>\n<p>GOP Sens. Rand Paul of Kentucky and Rick Scott of Florida argued that firing military members over their COVID vaccine decision is a far larger military readiness problem than unvaccinated members in the military.<\/p>\n<p>\u201cIt is outrageous that the U.S. military is firing young service members who choose not to get vaccinated,\u201d the pair wrote in a <a href=\"https:\/\/www.foxnews.com\/opinion\/time-end-military-covid-vaccine-mandate\" target=\"_blank\" rel=\"noopener\">Fox News<\/a> op-ed earlier this month.<\/p>\n<p>\u201cThe United States simply cannot afford to discharge our brave men and women in uniform and lose the investments we have made into each and every one of them due to an inept bureaucratic policy,\u201d they said.<\/p>\n<p>The NDAA does not prohibit Austin from instituting the vaccine mandate through another order, according to <a href=\"https:\/\/www.politico.com\/news\/2022\/12\/23\/biden-defense-bill-military-vaccine-mandate-00075437\" target=\"_blank\" rel=\"noopener\">POLITICO<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Joe Biden signed an $847 billion defense policy bill on Friday that includes a provision repealing the COVID vaccine mandate for the military.
