More than a month later, the South Dakota Board of Regents, the governing body of the public university whose members are appointed by the governor, <a href=\"https:\/\/www.dakotanewsnow.com\/2022\/12\/21\/sd-board-regents-develop-minors-campus-policy\/\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a> unanimously Wednesday to create a policy that would \u201cenhance the protection of minors on campus.\u201d <\/p>\n<p>The board also stated its central office would review \u201call upcoming campus events involving the presence of minors on campus\u201d before the policy is implemented. The board made no statement about its oversight of the use of tax dollars and tax-supported institutions sponsoring sexually themed shows for adults.<\/p>\n<p>The \u201ckid-friendly\u201d drag show at SDSU in November was orchestrated by the Gender and Sexualities Alliance student group. In advertisements for the erotic show, student organizers encouraged attendees to \u201cShow [their] support for the drag queens by bringing $1 or $5 bills to tip.\u201d<\/p>\n<p>A local news outlet <a href=\"https:\/\/www.dakotanewsnow.com\/2022\/11\/17\/sdsu-drag-show-organizers-performers-explain-their-kid-friendly-show\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>\u00a0that, according to one of the drag queens, the event featured \u201cage-appropriate attire, music, and behavior.\u201d However, a student who attended the performance told The Federalist on condition of anonymity the event was anything but child appropriate. \u201c[The drag queens] were twerking and then also shaking their chests at people,\u201d said the student.\u00a0<\/p>\n<p>At the time of the drag show, there were no guidelines for South Dakota campus events attended by minors. \u201cTo provide our universities and campus organizations with guidance on events where minors are invited, we have directed staff to expedite the formation of a Minors on Campus policy,\u201d said Board of Regents President Pam Roberts in a press release Wednesday.<\/p>\n<p>Last week, The Federalist\u00a0<a href=\"https:\/\/thefederalist.com\/2022\/12\/15\/south-dakota-state-university-hosted-a-kid-friendly-drag-show-and-gov-kristi-noem-is-doing-nothing-about-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>\u00a0on the event and pointed out Republican Gov. Kristi Noem\u2019s lack of public response to the event, although\u00a0<a href=\"https:\/\/sdlegislature.gov\/Statutes\/Codified_Laws\/2033557\" target=\"_blank\" rel=\"noreferrer noopener\">the governor has the power to appoint and fire<\/a> the university\u2019s governing Board of Regents. In a statement Noem provided to The Federalist Thursday, the governor <a href=\"https:\/\/fhaaction.org\/wp-content\/uploads\/here-.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> the board\u2019s new policy decision was \u201cAt [her] direction\u201d and \u201ca testament to [her] ability to govern for the people of South Dakota.\u201d<\/p>\n<p>Since the performance may <a href=\"https:\/\/sdlegislature.gov\/Statutes\/Codified_Laws\/2047410\" target=\"_blank\" rel=\"noreferrer noopener\">violate<\/a> South Dakota\u2019s \u201charmful to minors\u201d\u00a0<a href=\"https:\/\/sdlegislature.gov\/Statutes\/Codified_Laws\/2047386\" target=\"_blank\" rel=\"noreferrer noopener\">law<\/a>, Noem also has the power and responsibility to call on the state\u2019s attorney general to enforce South Dakota\u2019s laws \u2014 something she has done\u00a0<a href=\"https:\/\/www.argusleader.com\/story\/news\/city\/2019\/09\/18\/gov-kristi-noem-has-called-investigation-states-attorney-aaron-mcgowan\/2366501001\/\" target=\"_blank\" rel=\"noreferrer noopener\">in the past<\/a>. Noem could also push for bills that would ensure children are protected from similar events in the future, and that South Dakota\u2019s public institutions and tax dollars are prohibited from furthering sexually themed entertainment for adults.<\/p>\n<h2><strong>There Is More Work to Do<\/strong><\/h2>\n<p>On Monday, before the Board of Regents moved to create the new policy, South Dakota\u2019s Family Heritage Alliance Action Director Norman Woods wrote Noem a\u00a0<a href=\"https:\/\/fhaaction.org\/fha-action-letter-to-gov-noem-re-drag-queen-shows\/\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a>, stating he is \u201cgreatly disappointed [she] and [her] administration have taken no action to rectify this situation or to ensure that drag shows for children never happen again on South Dakota soil.\u201d <\/p>\n<p>Woods\u2019s letter asked Noem (1) if she would work with the attorney general to interpret South Dakota law banning the dissemination of \u201cpresentations\u201d depicting \u201csexual conduct\u201d to minors, (2) if she would support legislation that \u201cprotects\u201d children from \u201cfuture drag shows,\u201d and (3) if she had spoken to the Board of Regents and the president of South Dakota State University to prevent such events from happening in \u201ctaxpayer-funded buildings\u201d again.<\/p>\n<p>On Wednesday, Noem\u00a0<a href=\"https:\/\/fhaaction.org\/wp-content\/uploads\/here-.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">responded<\/a>\u00a0with a letter calling for Woods to be fired. \u201cI am disappointed in Mr. Woods\u2019 decision to attack me publicly by sending this letter out of the blue and releasing it to the media at the same time, instead of reaching out to my office to have a productive conversation about how we can work together,\u201d she wrote.\u00a0<\/p>\n<p>\u201cI urge you [the Family Heritage Alliance] to focus your efforts on bringing our shared pro-family message to the people of South Dakota,\u201d she added. \u201cI suggest you find an executive director who agrees.\u201d\u00a0<\/p>\n<p>The Federalist reached out to Noem for comment on her letter. In response, the governor said in a statement sent via staff Thursday, \u201cWe have taken action to solve the problem, and we would have been happy to educate Mr. Woods of those actions had he contacted us privately and not leaked his request to the media. This is nothing more than self-aggrandizing on his part and does nothing to advance the mission of the Family Heritage Alliance.\u201d<\/p>\n<p>In Noem\u2019s letter to the Family Heritage Alliance, she defended her handling of the \u201ckid-friendly\u201d drag show by bringing up the developments from the Board of Regents. The board made its announcement yesterday \u2014 two days after Woods\u2019s letter was published and more than a month after the kid-friendly drag show.<\/p>\n<p>Woods asked Noem in his letter if she would \u201cactively work with our state lawmakers to push legislation that protects South Dakota minors from future drag shows.\u201d In her response, Noem said that she \u201cwill continue to support legislation that builds stronger families in South Dakota and review any bill that the South Dakota State Legislature sends to my desk.\u201d\u00a0<\/p>\n<p>Noem also said that she \u201cwould welcome a clarification from the Attorney General\u2019s Office on whether or not the event \u2026 violated the state\u2019s decency statute. However, that is not for me to determine as Governor. I know what my job is \u2014 and what it isn\u2019t.\u201d <\/p>\n<p>The news from the Board of Regents is a welcome development, but more can be done by the governor, attorney general, and state legislature. South Dakota State University is not the only institution to host a sexually explicit event in the state using public resources. Earlier this year, the state\u2019s Vermillion Public Library\u00a0<a href=\"https:\/\/www.facebook.com\/events\/335718865303841\/?ref=newsfeed\" target=\"_blank\" rel=\"noreferrer noopener\">hosted<\/a>\u00a0a \u201cDrag Queen Storytime\u201d for children \u201cto celebrate Vermillion Pride.\u201d South Dakota still needs to prohibit taxpayer resources from funding sexually explicit events for residents of any age, but especially children.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Evita Duffy is a staff writer to The Federalist and the co-founder of the Chicago Thinker.
