And it\u2019s not getting any better,\u201d District Attorney Mike Schmidt said in a<br \/>\n<a class=\"Link\" href=\"https:\/\/www.mcda.us\/index.php\/news\/da-mike-schmidt-calls-lack-of-public-defenders-an-urgent-threat-to-public-safety\" target=\"_blank\" rel=\"noopener\">statement<\/a><br \/>\n last month.<\/p>\n<p>\u201cThis sends a message to crime victims in our community that justice is unavailable and their harm will go unaddressed,\u201d Schmidt said. \u201cIt also sends a message to individuals who have committed a crime that there is no accountability while burning through scarce police and prosecutor resources. Every day that this crisis persists presents an urgent and continuing threat to public safety.\u201d<\/p>\n<p>A review this year by the American Bar Association found the state\u2019s public defense system shockingly understaffed.<\/p>\n<p>\u201cOregon has only 31% of the public defense attorneys it needs to handle its adult and juvenile caseloads,\u201d the group noted in a<br \/>\n<a class=\"Link\" href=\"https:\/\/www.americanbar.org\/groups\/legal_aid_indigent_defense\/indigent_defense_systems_improvement\/publications\/or-project\/\" target=\"_blank\" rel=\"noopener\">report<\/a><br \/>\n.<\/p>\n<p>Oregon\u2019s public defense system is unique in that the Office of Public Defense Services does not employ the attorneys who are appointed to low-income suspects. Instead, the state office signs contracts with private law firms that do public defense work \u2014 and far too few contracts presently exist.<\/p>\n<p>To make matters worse, the rise in crime in Portland and beyond has placed a growing burden on that shrinking workforce.<\/p>\n<p>At least 80 of the Portland-area cases thrown out this year due to a lack of defense attorneys concerned alleged car thefts, according to the district attorney\u2019s office.<\/p>\n<p>Twenty-six of the cases dismissed between February and October concerned a felon allegedly in possession of a firearm.<\/p>\n<p>Fifteen of the cases involved alleged burglary or theft.<\/p>\n<p>The strain on the public defense system became an issue in this year\u2019s unusually competitive gubernatorial race, with all three candidates for governor promising to fix the problem.<\/p>\n<p>Democrat Tina Kotek, who ultimately won the contest,<br \/>\n<a class=\"Link\" href=\"https:\/\/www.opb.org\/article\/2022\/10\/19\/oregon-governor-candidate-tina-kotek-answers-questions\/\" target=\"_blank\" rel=\"noopener\">called the issue<\/a><br \/>\n a \u201cconstitutional emergency\u201d in October and vowed to support a working group tasked with identifying solutions.<\/p>\n<p>Part of the problem, experts say, is the enormous gap between the paychecks of public defenders and prosecutors in Multnomah County.<\/p>\n<p>\u201cWe have the greatest disparity in the United States that I have found between public defense pay and prosecutor pay in Multnomah County and Washington County, where the prosecutors are making two to three times what the attorneys make at our office,\u201d Carl Macpherson, head of Metropolitan Public Defenders, told<br \/>\n<a class=\"Link\" href=\"https:\/\/www.opb.org\/article\/2022\/12\/09\/oregon-criminal-justice-system-publid-defender-shortage-crisis\/\" target=\"_blank\" rel=\"noopener\">Oregon Public Broadcasting<\/a><br \/>\n earlier this month.<\/p>\n<p>The rise in crime has only worsened the burden on the criminal justice system in Portland.<\/p>\n<p><b><br \/>\n<a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\" target=\"_blank\" rel=\"noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><br \/>\n<\/b><\/p>\n<p>The city broke its<br \/>\n<a class=\"Link\" href=\"https:\/\/www.opb.org\/article\/2022\/11\/30\/portland-oregon-police-crime-homicide-gun-violence-shootings-ted-wheeler\/\" target=\"_blank\" rel=\"noopener\">all-time record<\/a><br \/>\n for murders in November when it logged its 93rd homicide.<\/p>\n<p>Other types of crime rose significantly over the last year as well.<\/p>\n<p>Portland recorded 9,212 motor vehicle thefts between January and October of this year, the most recent<br \/>\n<a class=\"Link\" href=\"https:\/\/www.portlandoregon.gov\/police\/71978\" target=\"_blank\" rel=\"noopener\">police data<\/a><br \/>\n available show; the city saw just 7,019 motor vehicle thefts during the same time frame last year.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A shortage of public defenders in Portland , Oregon, has led courts to dismiss hundreds of criminal cases and delayed justice for scores of other victims whose cases have languished in a backlog for months.
