They too have a right to exercise their faith, and to stand in their way is \u201cauthoritarian\u201d and \u201ctheocratic.\u201d<\/p>\n<p>Ocasio-Cortez is a perfect strawman for this piece because she completely misunderstands not only the Jewish position on abortion but religious freedom, as well.<\/p>\n<p>For one thing, does AOC, <a href=\"https:\/\/www.ncronline.org\/opinion\/ncr-connections\/aoc-future-catholic-church\" target=\"_blank\" rel=\"noreferrer noopener\">who is<\/a> purportedly Catholic, believe that Pope Francis \u2014 who, like every pontiff in history, views abortion as \u201c<a href=\"https:\/\/www.reuters.com\/world\/europe\/pope-says-abortion-is-murder-us-bishops-should-not-be-political-2021-09-15\/\" target=\"_blank\" rel=\"noreferrer noopener\">murder<\/a>\u201d \u2014 is a \u201cChristian fundamentalist\u201d? Perhaps. Until about five minutes ago, even science lovers <a href=\"https:\/\/www.princeton.edu\/~prolife\/articles\/embryoquotes2.html#:~:text=Life%20Begins%20at%20Fertilization%20with%20the%20Embryo&#039;s%20Conception&#038;text=%22Development%20of%20the%20embryo%20begins,together%20they%20form%20a%20zygote.%22&#038;text=%22Human%20development%20begins%20after%20the,known%20as%20fertilization%20(conception).\" target=\"_blank\" rel=\"noreferrer noopener\">believed<\/a> life began at conception. The abortion debate revolved around the ethical question of when life was worth protecting.<\/p>\n<p>These days, science <a href=\"https:\/\/www.wired.com\/2015\/10\/science-cant-say-babys-life-begins\/\" target=\"_blank\" rel=\"noreferrer noopener\">conforms<\/a> to our politics rather than the other way around. Increasingly, people demand faith do the same.\u00a0Perhaps the most contemptible achievement of many progressive Jewish groups isn\u2019t that they have cynically trashed a 3,000-year tradition, but that they\u2019ve convinced millions of Americans that radical cultural leftism is synonymous with Judaism. <\/p>\n<p>Nonetheless, AOC\u2019s Jewish brothers and sisters have no genuine theological case to make for abortion on demand as a sacrament. The congresswoman probably got the idea <a href=\"https:\/\/www.ldorvador.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">from<\/a> the Congregation L\u2019Dor Va-Dor \u2014 adherents of \u201ccosmic\u201d Judaism, an \u201call-inclusive, universal, and rational approach\u201d to faith. The temple recently filed a <a href=\"https:\/\/www.npr.org\/2022\/07\/03\/1109607681\/fl-lawsuit-argues-supreme-court-abortion-decision-violates-jewish-beliefs\" target=\"_blank\" rel=\"noreferrer noopener\">suit<\/a> which makes the preposterous claim that Florida\u2019s 15-week abortion restriction \u201cprohibits Jewish women from practicing their faith free of government intrusion and this violates their privacy rights and religious freedom.\u201d Three political activists in Kentucky <a href=\"https:\/\/www.washingtonpost.com\/religion\/2022\/10\/10\/kentucky-abortion-law-2022-jewish-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> similar lawsuits contending that state law infringes on their religious freedom by imposing a \u201cChristian understanding\u201d of life.<\/p>\n<p>Now, I\u2019m not a rabbi, but I feel slightly more qualified to comment on the Jewish faith than Ocasio-Cortez \u2014 and, while we\u2019re at it, the \u201crabbi\u201d of any cosmic shul. It would be misleading to assert that Jews adhere to the \u201c<a href=\"https:\/\/aish.com\/abortion-in-jewish-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">pro-life<\/a>\u201d position in the way many Evangelicals or Catholics do. But it would be <em>far<\/em> less misleading than calling the Jewish traditional view on abortion \u201cpro-choice\u201d \u2014 a position that, in its contemporary meaning, means on demand throughout nine months for any reason.<\/p>\n<p><a href=\"https:\/\/advocacy.ou.org\/ou-statement-roe-wade\/\" target=\"_blank\" rel=\"noreferrer noopener\">Here<\/a>, for instance, is the Orthodox Union\u2019s diplomatic reaction to the overturning of <em>Roe<\/em>:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>The Orthodox Union is unable to either mourn or celebrate the U.S. Supreme Court\u2019s overturning of Roe v Wade. We cannot support absolute bans on abortion \u2014 at any time point in a pregnancy \u2014 that would not allow access to abortion in lifesaving situations. Similarly, we cannot support legislation that does not limit abortion to situations in which medical (including mental health) professionals affirm that carrying the pregnancy to term poses real risk to the life of the mother.<\/p>\n<\/blockquote>\n<p>Neither the laws of Florida nor Kentucky \u2014 nor any state, for that matter \u2014 denies abortions for pregnancies that pose a real risk to the life of the mother. In any situation where abortion is required by Jewish law, it remains legal. Of course, <em>even<\/em> if we conceded for the sake of argument that the Jewish faith allows for abortion as a means of birth control, as AOC suggests, it is certainly not a sin to <em>avoid<\/em> getting one nor is it a <a href=\"https:\/\/www.myjewishlearning.com\/article\/mitzvot-a-mitzvah-is-a-commandment\/\" target=\"_blank\" rel=\"noreferrer noopener\">mitzvah<\/a> or a sacrament to seek one out. Abortion laws do not intrude on anyone\u2019s <em>religious<\/em> freedom. <\/p>\n<p>With <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>, the Supreme Court threw abortion back into the democratic process. Americans can now vote on the issue using any moral calculus they desire. Some might turn to Malthus or Marx for moral guidance. Others to Christ. <\/p>\n<p>But voting based on your beliefs is not theocratic. A theocratic policy entails things like state-imposed religious tests for office or a state-endorsed church or the state compelling people to praise church doctrine. Try imagining a florist or baker being compelled by the government to create speech that undermines their beliefs. Something like that. <\/p>\n<p>Indeed, Judaism\u00a0stresses the preservation and celebration of life.
