Here\u2019s what the experts are saying.<\/p>\n<p>National Review columnist Andy McCarthy, who formerly\u00a0served as an Assistant United States Attorney for the Southern District of New York, suggested the DOJ will not move to indict Trump in relation to January 6.<\/p>\n<p>\u201cThe hole in the committee\u2019s case has always been a criminally actionable nexus between Trump and the violence. There isn\u2019t one,\u201d McCarthy <a href=\"https:\/\/www.nationalreview.com\/2022\/12\/the-january-6-committees-final-act-pointless-criminal-referrals-of-trump\/\">explained<\/a> on the insurrection charge, adding that the other three charges don\u2019t fare any better.<\/p>\n<p>The legal expert argued that the committee\u2019s actions might actually work to <em>favor<\/em> Trump.<\/p>\n<p>\u201cThe anti-Trumpers of the January 6 committee would like to see Donald Trump be indicted,\u201d he wrote. \u201cThey would also like to be perceived as having caused Trump\u2019s indictment, credit they\u2019ll now claim if Trump gets charged after their referrals. But the blunt fact is that the committee\u2019s referrals will have no bearing on whether the Justice Department decides to charge Trump. <em>If the referrals have any relevance, it will be as Exhibit A in Trump\u2019s defense that any indictment is sheer partisan politics<\/em>\u201d (emphasis added).<\/p>\n<p>\u201cIt\u2019s not that the DOJ wouldn\u2019t love to charge Trump with a violent crime; it\u2019s that the DOJ doesn\u2019t want the egg of acquittal on its face,\u201d he added.<\/p>\n<p>McCarthy, though, left the door open on the DOJ moving against Trump concerning the raid at Mar-a-Lago. \u201cTo the extent the DOJ feels pressure to satisfy the Democratic base\u2019s craving for charges against Trump, a prosecution based on his retention of sensitive government documents at\u00a0Mar-a-Lago would be much cleaner.\u201d<\/p>\n<p>Former Trump-era Attorney General Bill Barr has <a href=\"https:\/\/thehill.com\/policy\/national-security\/3742921-barr-doj-probably-has-basis-for-legitimately-indicting-trump-over-mar-a-lago-documents\/\">suggested<\/a> the same.\u00a0Barr said last month that the department likely has a \u201cbasis for legitimately indicting\u201d Trump over the documents.<\/p>\n<p>\u201cIf the Department of Justice can show that these were indeed very sensitive documents, which I think they probably were, and also show that the president consciously was involved in misleading the department, deceiving the government, and playing games after he had received the subpoena for the documents, those are serious charges,\u201d the former AG told PBS\u2019s \u201cFiring Line.\u201d<\/p>\n<p>Constitutional expert Jonathon Turley seems to be in agreement with McCarthy about future J6-related trouble for Trump,\u00a0noting that the committee was focused on presenting Trump\u2019s \u201cinaction\u201d as opposed to building a case concerning the former president\u2019s actions to allegedly incite the breach.\u00a0<\/p>\n<p>\u201cBuilding a case on the failure to act is a very challenging prospect for prosecutors who need to satisfy elements of a crime,\u201d he posted to Twitter Monday. \u201cThe promise in the last hearing to produce new direct action failed to materialize.\u201d<\/p>\n<p>\u201cIt is important for the Committee to share evidence of action rather than inaction showing criminal acts by Trump,\u201d he said. \u201cMost of us viewed this as a disgraceful attack on our constitutional process, but criminal charges require proof of intent and other elements.\u201d<\/p>\n<p lang=\"en\" dir=\"ltr\">\u2026It is important for the Committee to share evidence of action rather than inaction showing criminal acts by Trump.
