Lake, who trails Hobbs by about 17,000 votes statewide, alleged that\u00a0\u201chundreds of thousands of illegal ballots\u201d were cast in Maricopa County and sought either a new election or to be declared the winner.<\/p>\n<p>She has alleged, among other claims, that Election Day voters were disenfranchised on Nov. 8 due to reports of widespread polling issues in Maricopa County, which were confirmed by Richer and Board of Supervisors Chairman Bill Gates during a press conference that day. Gates and Richer had told voters to place their ballots in secure drop boxes or cast their ballots in a different location, although Lake has since posted videos of Maricopa County residents reporting long lines and other irregularities on Nov. 8.<\/p>\n<p>\u201cLake received the greatest number of votes and is entitled to be named the winner,\u201d her lawsuit reads. \u201cAlternately, the election must be re-done in Maricopa County to eliminate the effects of maladministration and illegal votes on the vote tallies reported by Maricopa County.\u201d<\/p>\n<p>Lawyers for both Maricopa County and Hobbs filed motions to dismiss Lake\u2019s lawsuit last week, prompting the Dec. 19 hearing. They wrote that Lake\u2019s lawyers made false claims and didn\u2019t understand how the county\u2019s chain-of-custody process works.<\/p>\n<p>\u201cThis allegation is false, and will be easily disproven by the County if necessary,\u201d Maricopa County lawyers wrote in court papers (<a href=\"https:\/\/www.clerkofcourt.maricopa.gov\/home\/showpublisheddocument\/4321\/638067137081570000\">pdf<\/a>). \u201cPlaintiff reviewed the County\u2019s Early Voting Ballot Transport Statements, but the chain of custody documents for election day are different because the process for early ballot delivery is different on election day.\u201d<\/p>\n<p>They also wrote that if Lake\u2019s allegation were true, \u201cit does not follow that the Court should order Defendants to discard approximately twenty percent of Maricopa County\u2019s ballots.\u201d<\/p>\n<p>Also on Dec. 19, lawyers for Hobbs submitted a motion (<a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2022\/12\/CV2022095403-Contestee-Ho.pdf\">pdf<\/a>) to quash attempts to testify in her official capacity as Arizona\u2019s secretary of state.<\/p>\n<figure id=\"attachment_4833777\" class=\"wp-caption alignnone\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/11\/01\/Katie-Hobbs-1200x675.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"lazy size-medium wp-image-4833777\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" data-src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/12\/Katie-Hobbs-600x338-1.jpg\" alt=\"Epoch Times Photo\" width=\"600\" height=\"338\"   style=\"display:none\"><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4833777\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/12\/Katie-Hobbs-600x338-1.jpg\" alt=\"Epoch Times Photo\" width=\"600\" height=\"338\" \/><\/noscript><\/figcaption><\/a> Candidate for governor of Arizona Katie Hobbs attends a roundtable in Phoenix, Ariz., on Oct. 27, 2022. (Olivier Touron\/AFP via Getty Images)<\/figure>\n<p>\u201cHobbs was not served with a subpoena to testify in her personal capacity,\u201d reads the filing, issued via high-powered Democrat election law firms Perkins Coie and Elias Law Group. \u201cShe was subpoenaed to testify at trial in her official capacity as Arizona Secretary of State. Indeed, she was not personally served with a subpoena, and no one contacted her lawyers in her capacity as Governor-Elect to accept service. For that reason alone, any subpoena directed towards Governor-Elect Hobbs in her personal capacity should be denied.\u201d<\/p>\n<h2>Legal Victory<\/h2>\n<p>But over the weekend, Lake scored a legal victory when Judge Peter Thompson allowed her team to appoint an inspector to <a href=\"https:\/\/twitter.com\/BehizyTweets\/status\/1603820188062842880\/photo\/1?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1603820188062842880%7Ctwgr%5E55d7737d052037a7e5b69d4a7dab65ec597a2bef%7Ctwcon%5Es1_&#038;ref_url=https%3A%2F%2Fwww.westernjournal.com%2Fbreaking-judges-decision-kari-lakes-arizona-election-challenge-bad-news-katie-hobbs%2F\">analyze<\/a> a section of about 150 Maricopa County ballots that were cast during last month\u2019s contest. The inspection can start on Dec. 20 unless Thompson dismisses her case before then.<\/p>\n<p>During the hearing, the attorney for Maricopa County said affidavits from voters show most voters did cast their ballots but did have to wait in longer-than-normal lines. The attorney also stressed that there was no election misconduct or facts to support it. On the other side, Lake\u2019s attorney claims Maricopa County officials haven\u2019t publicly said they intend to get to the bottom of the Election Day problems.<\/p>\n<p>A Maricopa County Superior Court staffer told The Epoch Times on Dec. 19 that Thompson is likely to announce his ruling during a scheduled meeting on Dec. 22 at 9 a.m. local time. However, it\u2019s not clear when exactly the judge will make a decision.<\/p>\n<p>Should the motion to dismiss Lake\u2019s suit be denied, a short, two-day trial is scheduled to take place later in the week.<\/p>\n<p>Former Arizona secretary of state candidate Mark Finchem and U.S. House candidate Jeff Zink, both Republicans, filed a lawsuit earlier this month to challenge the Nov. 8 election results. On Dec. 16, a judge rejected their lawsuit with prejudice, which means it can\u2019t be filed again.<\/p>\n<p>Republican attorney general candidate\u00a0Abe Hamadeh similarly filed a lawsuit following his close race with Democrat Kris Mayes. A judge will hear a motion to dismiss his case later on Dec. 19 at the Maricopa County Superior Court.<\/p>\n<p>Lake\u2019s lawyer, Bryan Blehm, had no comment on the judge\u2019s decision to take the motion to dismiss.
