Today, we are asked,\u00a0<\/span><span>where Congress has not authorized the issuance of this mandate, whether the\u00a0<\/span><span>President may nonetheless exercise this power. We hold that he may not,&#8221; the\u00a0<\/span><span><a href=\"https:\/\/agjefflandry.com\/Files\/Article\/13102\/Documents\/Louisianav.Biden.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">ruling states<\/a><\/span><span>.\u00a0<\/span><\/p>\n<p>&#8220;As the Government\u2019s brief makes clear, questions surrounding the vaccine and the pandemic generally are undoubtedly of \u201cvast <span>economic and political significance.\u201d Id. Congress has not spoken clearly to\u00a0<\/span><span>authorize such a dramatic shift in the exercise of the President\u2019s power under\u00a0<\/span><span>the Procurement Act. Nor are historical exercises of that power sufficient to\u00a0<\/span><span>demonstrate a long-standing understanding that the Procurement Act could\u00a0<\/span><span>be used in this way,&#8221; the Court argued. &#8220;The President\u2019s use of procurement regulations to reach\u00a0<\/span><span>through an employing contractor to force obligations on individual employees\u00a0<\/span><span>is truly unprecedented. He also <a href=\"https:\/\/townhall.com\/tipsheet\/katiepavlich\/2021\/09\/09\/breaking-biden-will-use-osha-to-mandate-vaccinates-for-private-companies-n2595630\" rel=\"noopener noreferrer\" target=\"_blank\">issued a mandate through an executive order\u00a0<\/a>for private businesses.
