both fail for reasons of speculation,\u201d the judges wrote.<\/p>\n<p>The judges said that because the\u00a0Connecticut Interscholastic Athletic Conference, which governs high school sports, \u201cdid not have adequate notice that the Policy violates Title IX \u2014 indeed, they had notice to the contrary \u2014 Plaintiffs\u2019 claims for damages must be dismissed.\u201d<\/p>\n<p>The judges also referred to the Supreme Court\u2019s 2020 <a href=\"https:\/\/www.dailywire.com\/news\/breaking-supreme-court-rules-lgbt-individuals-protected-from-job-discrimination-under-title-vii\">decision<\/a> ruling that the Civil Rights Act prohibits discrimination on the\u00a0basis of gender identity as well as sex.<\/p>\n<p>\u201cThus, it cannot be said that the Policy \u2013 which prohibits discrimination based on a student\u2019s transgender status by allowing all students to participate on gender specific teams consistent with their gender identity \u2013 \u2018falls within the scope of Title IX\u2019s proscriptions,&#8217;\u201d the judges wrote.<\/p>\n<p>The girls were represented by\u00a0Alliance Defending Freedom (ADF), which argued their case before the 2nd Circuit in September. The group\u2019s attorneys said they were looking at all their options after Friday\u2019s defeat.<\/p>\n<p>\u201cThe 2nd Circuit got it wrong, and we\u2019re evaluating all legal options, including appeal,\u201d ADF senior counsel Christiana Kiefer <a href=\"https:\/\/www.foxnews.com\/sports\/federal-court-rejects-challenge-female-athletes-connecticut-transgender-sports-policy\">said<\/a>. \u201cOur clients\u2014like all female athletes\u2014deserve access to fair competition. Thankfully, a growing number of states are stepping up to protect women\u2019s athletics.\u201d<\/p>\n<p>Meanwhile the American Civil Liberties Union (ACLU) celebrated the victory.<\/p>\n<p>\u201cThe court rejected the baseless zero-sum arguments presented by the opposition to this policy and ultimately found transgender girls have as much a right to play as cisgender girls under Title IX,\u201d said Joshua Block, senior staff attorney for the ACLU\u2019s LGBTQ &#038; HIV Project.\u00a0\u201cThis critical victory strikes at the heart of political attacks against transgender youth while helping ensure every young person has the right to play.\u201d<\/p>\n<p>Women\u2019s and girls\u2019 sports have remained a battleground for the transgender issue across the country. At least 18 states now <a href=\"https:\/\/www.foxnews.com\/sports\/federal-court-rejects-challenge-female-athletes-connecticut-transgender-sports-policy\">have<\/a> legislation that aims to bar biological males from competing on girls and women\u2019s sports teams.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Four female athletes who sued over a Connecticut transgender sports policy lost their case in federal court on Friday.
