Despite the highly publicized move, the Justice Department is under no obligation to act on the recommendations, and under the <a href=\"https:\/\/www.dailywire.com\/news\/trump-special-counsel-sends-subpoenas-to-officials-in-7-states\" target=\"_blank\" rel=\"noopener\">leadership of special counsel Jack Smith<\/a> could seek other charges not included in the slate of referrals. The January 6 panel also voted to make ethics referrals against several House Republicans for refusing to comply with subpoenas.<\/p>\n<p>The <a href=\"https:\/\/s3.documentcloud.org\/documents\/23466439\/j6-executive-summary.pdf\" target=\"_blank\" rel=\"noopener\">executive summary<\/a> of the January 6 panel\u2019s report offers insight into the referral decision-making process, including statutes members took under consideration for referrals but did not act upon during the public meeting Monday. One was the seditious conspiracy statute, which prohibits \u201cconspir[acy] to overthrow, put down, or to destroy by force the Government of the United States \u2026 or to oppose by force the authority thereof, or by force to prevent, hinder or delay the execution of any law of the United States.\u201d The other charge that was considered focused on a statute against conspiring to impede and injure an officer of the United States.<\/p>\n<p>Although these particular statutes did not come to a vote Monday, the summary stresses that members \u201cbelieve sufficient evidence exists for a criminal referral of President Trump,\u201d and notes the Justice Department \u201cthrough its investigative tools that exceed those of this Committee, may have evidence sufficient to prosecute\u201d him.<\/p>\n<p>\u201cThere is a rigorous factual proof following particular legal elements that are there. And we brought forth those offenses where we think it\u2019s just clear that criminal conduct took place,\u201d said Rep. Adam Schiff (D-CA), a member of the panel, according to <a href=\"https:\/\/twitter.com\/etuckerAP\/status\/1604938906956357632\" target=\"_blank\" rel=\"noopener\">an Associated Press reporter<\/a>.<\/p>\n<p>The summary also mentions \u201cconcerns\u201d about possible obstruction of the panel\u2019s investigation and notes that the committee \u201cconcluded that it is critical\u201d to hold accountable anyone who may have assisted a broad plan to overturn the 2020 election results. A final report is expected to be released on Wednesday.<\/p>\n<p>Trump, who <a href=\"https:\/\/www.dailywire.com\/news\/breaking-trump-launches-third-bid-for-white-house\" target=\"_blank\" rel=\"noopener\">announced last month<\/a> he is embarking on a third campaign for the White House, has broadly denied any wrongdoing, and he <a href=\"https:\/\/www.cbsnews.com\/live-updates\/house-january-6-committee-final-hearing-watch-live-stream-today-2022-12-19\/\" target=\"_blank\" rel=\"noopener\">has chastised the January 6 panel<\/a> as being the \u201cUnselect Committee of political hacks.\u201d A group of House Republicans, including those denied membership in the January 6 Committee by Speaker Nancy Pelosi (D-CA), <a href=\"https:\/\/www.dailywire.com\/news\/republicans-prepare-rebuttal-january-6-report\" target=\"_blank\" rel=\"noopener\">have prepared their own rebuttal report<\/a>, which is expected to focus on law enforcement issues as well as intelligence gathering and dissemination by the FBI as they relate to the Capitol riot on January 6, 2021.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The House January 6 Committee recommended to the Justice Department on Monday several charges against former President Donald Trump and his allies, but left out referrals for multiple conspiracy allegations that were under consideration.
