Jamie Raskin, unveiling agency referrals.<\/p>\n<p>It will now be up to the Justice Department, which is run by rabid partisan <a href=\"https:\/\/thefederalist.com\/2022\/06\/24\/merrick-garlands-department-of-justice-is-a-threat-to-the-republic\/\" target=\"_blank\" rel=\"noreferrer noopener\">Merrick Garland<\/a>, to determine whether to follow through with prosecution. Former President Trump is already under another politicized <a href=\"https:\/\/thefederalist.com\/2022\/11\/19\/garland-moves-to-transform-j6-inquisition-into-a-permanent-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">investigation<\/a> from the department with a special counsel probing whether Trump violated the Presidential Records Act. <\/p>\n<p>Monday\u2019s criminal referrals accuse Trump of conspiring to obstruct an official proceeding, defraud the United States, make false statements to federal officials, and \u201cincite\u201d an insurrection <a href=\"https:\/\/thefederalist.com\/2022\/01\/06\/one-year-ago-today-a-new-hoax-was-born\/\" target=\"_blank\" rel=\"noreferrer noopener\">linked to the events<\/a> on Jan. 6, 2021. <\/p>\n<p>Raskin, who <a href=\"https:\/\/thefederalist.com\/2022\/06\/13\/second-j6-hearing-criminalizes-republicans-for-election-objections-after-democrats-made-them-for-decades\/\" target=\"_blank\" rel=\"noreferrer noopener\">objected<\/a> to the certification of electoral votes in 2016, also announced four GOP colleagues will be referred to the House Ethics Committee for refusal to comply with the panel\u2019s subpoenas. While Raskin did not name the members recommended for congressional sanctions, the committee subpoenaed GOP leader Kevin McCarthy and Reps. Jim Jordan of Ohio, Scott Perry of Pennsylvania, and Andy Biggs of Arizona.<\/p>\n<p>\u201cAn insurrection is a rebellion against the authority of the United States. \u2026 [The Constitution] uses participation in insurrection by office-holders as automatic grounds for disqualification from ever holding public office again,\u201d Raskin added, revealing the true purpose of the probe\u2019s investigation all along. <\/p>\n<p>The Select Committee was established in the aftermath of Democrats\u2019 failed efforts to secure a conviction of President Trump through a snap impeachment. Even though Trump was no longer in office when he went on trial in the upper chamber for the second time, a guilty vote would have barred him from running for office in 2024. Trump <a href=\"https:\/\/thefederalist.com\/2022\/11\/16\/donald-trump-is-running-for-president-again-washington-would-be-wise-to-remember-2016\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> his candidacy for a second term last month.<\/p>\n<p>In October, the panel wrapped up its final public hearing with a <a href=\"https:\/\/thefederalist.com\/2022\/10\/13\/j6-theatrics-end-with-performative-subpoena-of-donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">performative subpoena<\/a> of Trump to close out its pre-election show trials. The committee secured a series of indictments of former officials from the Trump administration over the summer, including Trump trade adviser Peter Navarro and strategist Steve Bannon. <\/p>\n<p>Bannon was ultimately <a href=\"https:\/\/www.justice.gov\/usao-dc\/pr\/stephen-k-bannon-sentenced-four-months-prison-two-counts-contempt-congress\" target=\"_blank\" rel=\"noreferrer noopener\">sentenced<\/a> to four months in federal prison after his refusal to comply with a committee subpoena provoked contempt of Congress charges, which were subsequently <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-resolution\/730\/text\" target=\"_blank\" rel=\"noreferrer noopener\">approved<\/a> by the full lower chamber in October.
