David Cicilline, D-R.I., one of the House Democrats who led the <a href=\"https:\/\/www.foxnews.com\/politics\/congress-obligated-impeach-trump-capitol-riot-cicilline\" target=\"_blank\" rel=\"noopener\">second impeachment effort<\/a> against Trump, introduced legislation Thursday with 40 Democratic co-sponsors that would invoke Section 3 of the 14th Amendment to prevent Trump from returning to the White House, or holding any other office.\u00a0<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/category\/us\/constitution\" target=\"_blank\" rel=\"noopener\">The amendment states<\/a>, &#8220;No person shall \u2026 hold any office, civil or military, under the United States \u2026 who, having previously taken an oath, as a member of Congress, or as an officer of the United States \u2026 to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.&#8221;\u00a0<\/p>\n<p>Democrats argue that this language \u2013 adopted in the 1860s to prevent former Confederates from occupying positions in the federal government after the Civil War \u2013 should be applied to Trump, who they allege <a href=\"https:\/\/www.foxnews.com\/category\/us\/capitol-protests\" target=\"_blank\" rel=\"noopener\">incited an insurrection against the United States<\/a> on Jan. 6, 2021.\u00a0<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/trump-roasted-after-major-announcement-turns-out-digital-trading-cards\" target=\"_blank\" rel=\"noopener\"><strong>TRUMP ROASTED AFTER \u2018MAJOR ANNOUNCEMENT\u2019 TURNS OUT TO BE DIGITAL TRADING CARDS<\/strong><\/a><\/p>\n<div class=\"image-ct inline\">\n<div class=\"m\"><source media=\"(max-width: 767px)\" \/><source media=\"(min-width: 767px) and (max-width: 1023px)\" \/><source media=\"(min-width: 1024px) and (max-width: 1279px)\" \/><source media=\"(min-width: 1280px)\" \/><img decoding=\"async\" src=\"https:\/\/a57.foxnews.com\/static.foxnews.com\/foxnews.com\/content\/uploads\/2022\/12\/640\/320\/david-cicilline-house-of-representatives.jpg?ve=1&#038;tl=1\" alt=\"Commercial and Administrative Law House Subcommittee Chairman Rep. He has not appeared at any public campaign events nor traveled outside his home state of Florida. \u00a0\u00a0<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/apps-products?pid=AppArticleLink\" target=\"_blank\" rel=\"noopener\"><strong><u>CLICK HERE TO GET THE FOX NEWS APP<\/u><\/strong><\/a><strong>\u00a0<\/strong><\/p>\n<p>It is unclear whether Democratic leadership will schedule a vote on Cicilline&#8217;s bill before the current legislative session ends.
