It requires illegal aliens who claim to seek asylum to wait in Mexico until their case is heard, instead of detaining them or allowing them to stay in the United States while they undergo immigration proceedings.<\/p>\n<p>U.S. District Judge Matthew Kacsmaryk for the Northern District of Texas on Thursday <a href=\"https:\/\/www.courtlistener.com\/docket\/59815977\/178\/state-of-texas-v-joseph-r-biden\/\">ordered<\/a> that the Biden administration\u2019s efforts to end the MPP\u00a0is paused until legal proceedings play out in an ongoing\u00a0<a href=\"https:\/\/www.courtlistener.com\/docket\/59815977\/state-of-texas-v-joseph-r-biden-in-his-official-capacity-as-president-of\/?filed_after=&#038;filed_before=&#038;entry_gte=&#038;entry_lte=&#038;order_by=desc\">lawsuit<\/a>\u00a0that Republican states Texas and Missouri brought back in April 2021. The two states oppose the termination of the MPP.<\/p>\n<p>President Joe Biden had suspended the MPP on his first day in office in January 2021, and the Department of Homeland Security (DHS) officially terminated it in June 2021. The Biden administration was ordered to reinstate the policy <a href=\"https:\/\/www.theepochtimes.com\/judge-orders-biden-administration-to-resume-remain-in-mexico-policy_3948655.html\">on August 2021<\/a> after Texas and Missouri sued, saying the move had worsened conditions at the border.<\/p>\n<p>Despite the court order, Homeland Security Secretary Alejandro Mayorkas\u00a0tried to end the program again in October 2021\u00a0via a <a href=\"https:\/\/www.theepochtimes.com\/dhs-secretary-mayorkas-ends-remain-in-mexico-program-despite-court-order_4076382.html\">new memorandum<\/a>. He argued that while the policy \u201clikely contributed to reduced migratory flows,\u201d it did so \u201cby imposing substantial and unjustifiable human costs on the individuals who were exposed to harm while waiting in Mexico.\u201d<\/p>\n<p>Meanwhile, following appeals, the case made its way to the Supreme Court, which ruled on June 30 in a split decision that the\u00a0Biden administration has the authority to end the program.<\/p>\n<p>The same court also returned the case to\u00a0Kacsmaryk to determine whether the Biden administration\u2019s issuance of the\u00a0<a href=\"https:\/\/www.theepochtimes.com\/dhs-secretary-mayorkas-ends-remain-in-mexico-program-despite-court-order_4076382.html\">October 2021 memo<\/a>\u00a0to end the MPP was in violation of the\u00a0Administrative Procedure Act, which sets out how federal agencies take certain steps when implementing policy, leading to the latest decision by the Texas judge.<\/p>\n<p>Texas Attorney General Ken Paxton cheered the decision on <a href=\"https:\/\/twitter.com\/KenPaxtonTX\/status\/1603570142603907073?s=20&#038;t=k5csKN54ThSDGGDprdXaaA\">Twitter<\/a>. \u201cI sued Biden nearly 2 yrs. ago to keep Remain-in-Mexico. The Admin played games all the way to SCOTUS, but tonight Texas &#038; USA WINS.<\/p>\n<p>\u201cI just secured an order from a federal court ordering Biden not to scrap the program,\u201d Paxton added. \u201cBiden\u2019s open-border agenda won\u2019t survive my legal attacks.\u201d<\/p>\n<p>The MPP is separate from Title 42, which is <a href=\"https:\/\/www.theepochtimes.com\/biden-administration-plans-for-more-illegal-aliens-to-be-released-into-communities-when-title-42-ends_4925651.html\">set to end<\/a> on Dec. 21. The Trump administration introduced Title 42 in 2020 at the start of the COVID-19 pandemic. The policy allows illegal aliens to be denied asylum to\u00a0prevent the introduction of contagious diseases in the United States.
