PDE asked the court to issue a preliminary injunction to halt the policy while the case progressed. District Judge C.J. Williams denied their request in September.<\/p>\n<p>The case is now before the St. Louis-based Eighth Circuit Court of Appeals. So far, the AGs and 47 organizations filed briefs in support of PDE, including First Liberty Institute, Liberty Justice Center, Institute for Free Speech &#038; Moms for Liberty, and the Justice Foundation &#038; Parental Rights Iowa.<\/p>\n<p>\u201cParents have a fundamental constitutional right to direct the upbringing and care of their children. School policies cannot intentionally leave parents in the dark about their child\u2019s mental and emotional well-being,\u201d Knudsen said. \u201cThe courts must step in to protect these kids and stop the violation of parental rights at the hands of woke school administrators.\u201d<\/p>\n<p>The AGs are \u201cpushing back against woke school administrators who are encouraging students to \u2018transition\u2019 without their parents\u2019 knowledge or consent,\u201d Texas Attorney General Ken Paxton, who joined the AG coalition, said.<\/p>\n<p>The AG\u2019s asked the court to reverse Williams\u2019 decision, arguing Linn-Mar\u2019s policy causes \u201cimmediate and irreparable harm on parents by withholding information on their child\u2019s gender identity.\u201d<\/p>\n<p>\u201cLinn-Mar\u2019s policy violates parents\u2019 fundamental right to \u2018to direct the upbringing of their children\u2019 \u2013 \u2018perhaps the oldest of the fundamental liberty interests recognized by [the Supreme] Court,\u2019\u201d they argue in their brief. \u201cThe policy inflicts an immediate and irreparable harm on parents by withholding information about whether their child has taken any action concerning his or her gender identity, leaving parents completely in the dark about their child\u2019s mental and emotional well-being.\u201d<\/p>\n<p>PDE\u2019s lawsuit challenges school district policy that allows seventh through twelfth grade students to devise a \u201cGender Support Plan\u201d and make other decisions without notifying their parents.<\/p>\n<p>Although the policy applies to \u201ctransgender students, gender-expansive students, nonbinary, gender nonconforming students, and students questioning their gender,\u201d any student may \u201crequest\u201d to create such a plan. Those who do can decide who attends a meeting with district officials \u201cwithin 10 school days\u201d to develop it, \u201cincluding whether their parent\/guardian will participate.\u201d<\/p>\n<p>The policy states the plan \u201cwill have priority &#8230; over their parent\/guardian\u201d at least for \u201c[a]ny student in seventh grade\u201d or higher. However, it also notes that creating a plan \u201cis not required for a student\u201d to adopt a transgender or nonbinary identity at school without their parents&#8217; knowledge.<\/p>\n<p>The policy also instructs plans to be maintained in a \u201cstudent\u2019s temporary records, not the student\u2019s permanent records,\u201d and all conversations \u201cbetween students and school counselors\u201d or other staff members and \u201call written records related to student meetings concerning their gender identity and\/or gender transition with any staff member will be kept in a temporary file that shall be maintained by the school counselor.\u201d<\/p>\n<p>Parents are not given access to the temporary files due to students\u2019 \u201cright to privacy\u201d and school district employees are instructed to \u201cnot disclose information that may reveal a student\u2019s transgender status to others including &#8230; parents &#8230; unless legally required to do so &#8230; or unless the student\u201d consents. It also prohibits school staff from \u201ccontacting [a student\u2019s] parent\/guardian\u201d without \u201ccheck[ing] with the student first.\u201d<\/p>\n<p>The policy also allows students to decide which locker rooms and bathrooms they want to use, according to school district board members who voted 5-2 in April to pass it.
