However, the federal rule, upon which these holdings were made, is substantively different from Iowa rules and therefore, distinguishable,\u201d the <a href=\"https:\/\/www.aclu-ia.org\/sites\/default\/files\/orot_eqce0830745022356820844866854.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a> read.<\/p>\n<p>\u201cThere is not a specific federal rule on dissolving permanent injunctions,\u201d she added.<\/p>\n<p>Republican Gov. Kim Reynolds, who signed the state\u2019s fetal heartbeat bill into law in 2018, said she would appeal the decision to the Iowa Supreme Court.<\/p>\n<p>The bill banned abortion in the state after the detection of a fetal heartbeat (generally at about six weeks), with exceptions for rape, incest, fetal abnormality, and medical emergencies.<\/p>\n<p>The Iowa Supreme Court issued a permanent injunction in 2019 against the law, ruling that it violated the state\u2019s Constitution and past precedent.<\/p>\n<p>Iowa\u2019s conservative lawmakers sought to end the injunction following the Supreme Court\u2019s overturn of <em>Roe v. Wade <\/em>in June which returned abortion policies to states.<\/p>\n<p>\u201cNow is the time for us to stand up and continue the fight to protect the unborn,\u201d Reynolds <a href=\"https:\/\/governor.iowa.gov\/press-release\/gov-reynolds-and-legislative-leaders-announce-legal-action-to-protect-life%C2%A0\" target=\"_blank\" rel=\"noopener\">said<\/a> in June. \u201cThe Supreme Court\u2019s historic decision reaffirms that states have the right to protect the innocent and defenseless unborn\u2014and now it\u2019s time for our state to do just that.\u201d<\/p>\n<p>In June, the state\u2019s Supreme Court <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/3527700-iowa-supreme-court-rules-against-abortion-protections\/\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that abortion is not protected in the Iowa Constitution, overturning its previous decision.<\/p>\n<p>Judge Gogerty noted that it did not provide a clear standard for what should replace the previous ruling, claiming the six-week ban would be an \u201cundue burden\u201d and therefore was unconstitutional. Instead, the ruling leaves the state\u2019s current law prohibiting abortion after 20 weeks of pregnancy intact.<\/p>\n<p>A leader from Planned Parenthood celebrated the ruling.<\/p>\n<p>\u201cThe district court\u2019s decision is a huge win for abortion rights and bodily autonomy in Iowa. For now, abortion remains safe and legal in the state, and Iowans will continue to have control over their ability to determine their lives and futures,\u201d said Planned Parenthood North Central States President and CEO Ruth Richardson in a Monday <a href=\"https:\/\/www.desmoinesregister.com\/story\/news\/crime-and-courts\/2022\/12\/12\/abortion-iowa-fetal-heartbeat-law-remain-blocked-kim-reynolds-appeal\/69722568007\/\" target=\"_blank\" rel=\"noopener\">statement<\/a>.<\/p>\n<p>The governor also released a statement following the Monday ruling to address the importance of continuing the fight for the sanctity of life.<\/p>\n<p>\u201cAs the Iowa and US Supreme Courts have made clear, there is no fundamental right to an abortion,\u201d Reynolds <a href=\"https:\/\/governor.iowa.gov\/press-release\/gov-reynolds-issues-statement-in-response-to-court-ruling-on-fetal-heartbeat-law%C2%A0%C2%A0\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. \u201cThe decision of the people\u2019s representatives to protect life should be honored, and I believe the court will ultimately do so.
