The DOJ also will not require an independent compliance monitor if the company has rolled out an effective compliance program.<\/p>\n<p>While speaking at a conference held by the American Bankers Association in Maryland, Miller noted that all elements of the DOJ that handle corporate crime cases are updating their policies accordingly, building upon a framework <a href=\"https:\/\/www.justice.gov\/opa\/speech\/deputy-attorney-general-lisa-o-monaco-delivers-remarks-corporate-criminal-enforcement\">announced in September<\/a> by Deputy Attorney General Lisa Monaco.<\/p>\n<p>\u201cWhen misconduct occurs, we want companies to step up and own up,\u201d Miller said. \u201cWhen companies do, they can expect to fare better in a clear and predictable way.\u201d<\/p>\n<p>To give the policy more teeth, the DOJ is pushing corporations to adopt compensation clawback measures, which financially penalize executives and other employees whose actions or omissions led to criminal conduct.<\/p>\n<p>A major test of the department\u2019s policy was the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/abb-agrees-pay-over-315-million-resolve-coordinated-global-foreign-bribery-case\">resolution of a case<\/a>\u00a0on Dec. 2 involving ABB Ltd., a Swiss\u00a0engineering company that agreed to pay $315 million to end a multinational investigation into a bribery scheme in South Africa.<\/p>\n<p>Two of ABB\u2019s subsidiaries pleaded guilty to conspiracy to violate the U.S. Foreign Corrupt Practices Act, and the parent company entered into a three-year deferred prosecution agreement with the DOJ. ABB took active steps to report the wrongdoing to the DOJ and the Securities and Exchange Commission.<\/p>\n<p>Miller also addressed the burgeoning fraud and criminal activity in the cryptocurrency sector, citing several instances of \u201claw enforcement disruptions\u201d where the DOJ t0ok action against scammers and ransomware actors and helped seize and recover ill-gotten digital assets.<\/p>\n<p>\u201cThe department has been closely tracking the extreme volatility in the digital assets market over the past year,\u201d he added.<\/p>\n<p>The warning may have referred to the collapsed crypto exchange <a href=\"https:\/\/www.theepochtimes.com\/t-ftx\">FTX<\/a>, whose founder, <a href=\"https:\/\/www.theepochtimes.com\/t-sam-bankman-fried\">Sam Bankman-Fried<\/a>,\u00a0<a href=\"https:\/\/www.theepochtimes.com\/ftxs-sam-bankman-fried-reveals-he-cant-account-for-billions-sent-to-alameda-research_4912770.html\">admitted<\/a>\u00a0that he doesn\u2019t know what happened to billions of dollars of customer funds. The DOJ\u2019s Office of the U.S. Trustee\u2014the agency\u2019s bankruptcy watchdog\u2014called for an <a href=\"https:\/\/www.theepochtimes.com\/doj-watchdog-urges-probe-into-ftx-collapse-amid-serious-allegations-of-fraud-dishonesty-incompetence_4902098.html\">independent investigation<\/a> into FTX on Dec. 1.<\/p>\n<p>Within the last year, the DOJ has created two new groups related to digital assets: the National Cryptocurrency Enforcement Team at DOJ headquarters and the Digital Assets Coordinators in the offices of all 94 U.S attorneys, Miller said.<\/p>\n<p>The Federal Bureau of Investigation has also launched a new unit that will work closely with the two groups to probe illicit use of virtual assets.<\/p>\n<div class=\"author_wrapper\">\n<div class=\"one_author_block round\">\n<div class=\"top_row\">\n\t\t\t\t\t<a href=\"https:\/\/www.theepochtimes.com\/author-greg-isaacson\"><img decoding=\"async\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/02\/16\/ttl7dayUo7_WEB_GregIsaacson.jpg\" alt=\"Greg Isaacson\"     style=\"display:none\"><\/a><\/p>\n<p>Follow<\/p>\n<\/div>\n<p>Greg Isaacson spent 7 years in China and Thailand researching and reporting on business and real estate in Asia, with a focus on commercial real estate in Chinese-speaking markets as well as outbound investment from China.
