Becerra<\/em>, a coalition of Catholic hospitals, nuns, and a Catholic university that run health clinics for the poor sued the Biden administration over a Department of Health and Human Services mandate that would have compelled religious doctors and hospitals to administer mutilative gender \u201creassignment\u201d surgeries \u2014 even if the surgeries violated the healthcare provider\u2019s conscience.<\/p>\n<p>The mandate, which was first issued in 2016, interpreted the Affordable Care Act to require doctors to perform such surgeries on any patient \u2014 including children \u2014 even if the medical provider believed the surgery would harm the patient. <\/p>\n<p>The Eighth Circuit\u2019s opinion comes after the Fifth Circuit Court of Appeals <a href=\"https:\/\/becketnewsite.s3.amazonaws.com\/20220826221641\/Eighth-Circuit-Franciscan-Opinion.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> this past August that the Affordable Care Act could not require doctors to perform sex change surgeries if it violated their conscience. <\/p>\n<p>The Eighth Circuit affirmed the Louisiana-based appeals court decision.<\/p>\n<p>\u201cWe agree with these courts and therefore conclude that the district court correctly held that \u2018intrusion upon the Catholic Plaintiffs\u2019 exercise of religion is sufficient to show irreparable harm,\u2019\u201d the eighth circuit wrote in its <a href=\"https:\/\/ecf.ca8.uscourts.gov\/opndir\/22\/12\/211890P.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a>. <\/p>\n<p>While the Eighth Circuit\u2019s ruling is not a nationwide injunction (only the named parties are its beneficiaries), it does set a helpful precedent for religious liberty cases in the future. <\/p>\n<p>\u201cToday\u2019s victory sets an important precedent that religious healthcare professionals are free to practice medicine in accordance with their consciences and experienced professional judgment,\u201d\u00a0Tim Goodrich, vice president and senior counsel at Becket Law, <a href=\"https:\/\/www.google.com\/url?q=https:\/\/www.becketlaw.org\/media\/federal-appeals-court-blocks-controversial-biden-administration-transgender-mandate\/&#038;source=gmail&#038;ust=1670698889672000&#038;usg=AOvVaw1V27JjvEFBwU9TIrCz4Jdk\" target=\"_blank\" rel=\"noreferrer noopener\">said in a press release<\/a>. \u201cThe government\u2019s attempt to force doctors to go against their consciences was bad for patients, bad for doctors, and bad for religious liberty.\u201d<\/p>\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/BREAKING?src=hash&#038;ref_src=twsrc%5Etfw\">#BREAKING<\/a>: The 8th Circuit just ruled against the Biden Admin\u2019s transgender mandate, which tried to force religious doctors and hospitals to perform gender transitions against their conscience and medical judgment.
