Thirty-nine Republicans joined all Democrats in the lower chamber to pass the bill. One Republican voted present, and four did not vote.<\/p>\n<p>The House had <a href=\"https:\/\/www.theepochtimes.com\/house-passes-same-sex-marriage-bill-backed-by-47-republicans_4608854.html\">passed the bill in July<\/a>\u00a0but was voting again because the Senate <a href=\"https:\/\/www.theepochtimes.com\/senate-rejects-religious-freedom-protections-approves-respect-for-marriage-act-biden-to-sign_4892560.html\">amended it in November<\/a>.<\/p>\n<p>The content of the bill includes a codification of the Supreme Court\u2019s 2014 ruling in Obergefell v. Hodges, which declared a federal right to same-sex marriage on grounds of the 14th amendment\u2019s \u201cequal protection\u201d clause.<\/p>\n<p>\u201cI began my career fighting for LGBTQ communities\u2014and now, one of the final bills that I will sign as Speaker will ensure the federal government never again stands in the way of marrying the person you love,\u201d Speaker of the House <a href=\"https:\/\/www.theepochtimes.com\/t-nancy-pelosi\">Nancy Pelosi<\/a> (D-Calif.) said in a recent statement.<\/p>\n<p>Critics of the bill have warned of the potential for it to target faith-based organizations, and have refuted the notion that it is merely a codification of Obergefell.<\/p>\n<p>\u201cThe truth is the Respect for Marriage Act does nothing to change the status of same-sex marriage or the benefits afforded to same-sex couples following Obergefell,\u201d the conservative Alliance Defending Freedom wrote <a href=\"https:\/\/adflegal.org\/article\/what-you-should-know-about-respect-marriage-act\">in a blog post.<\/a>\u00a0\u201cIt does much, however, to endanger religious freedom.\u201d<\/p>\n<p>The Alliance Defending Freedom described the bill as \u201ca direct attack on the religious freedom of millions of Americans with sincerely held beliefs about marriage.\u201d<\/p>\n<p>They said that by recognizing same-sex marriage in law, the bill \u201cembeds a false definition of marriage in the American legal fabric.\u201d<\/p>\n<p>Further, they warned, \u201cIt opens the door to federal recognition of polygamous relationships\u201d and\u00a0\u201cjeopardizes the tax-exempt status of nonprofits that exercise their belief that marriage is the union of one man and one woman.\u201d<\/p>\n<p>Republican proponents of the bill denied this charge, saying that it ensured that same-sex marriages would be protected while respecting the rights of faith-based institutions.<\/p>\n<h2>Senate Passage<\/h2>\n<p><a href=\"https:\/\/www.theepochtimes.com\/senate-moves-closer-to-passing-respect-for-marriage-act-that-critics-say-threatens-religious-freedom_4890512.html\">The Senate passed<\/a> the final package of the Respect for Marriage Act on Nov. 28.<\/p>\n<p>Ahead of a key vote to advance the package, Sen. Mitt Romney (R-Utah), who often defects from his party, tied his support for the bill to this condition.<\/p>\n<p>\u201cIf it includes important protections for religions and religious institutions, I will support it,\u201d Romney <a href=\"https:\/\/www.politico.com\/news\/2022\/11\/16\/same-sex-marriage-bill-senate-gop-support-00067104\" target=\"_blank\" rel=\"noopener\">told Politico.<\/a><\/p>\n<p>Other Republicans, including Sens. Roy Blunt (R-Mo.) and Joni Ernst (R-Iowa) demurred from telling reporters how they would vote on advancing the bill ahead of the vote.<\/p>\n<p>Ultimately, the bill garnered enough support to pass the upper chamber easily.<\/p>\n<p>12 Republicans joined Democrats to support the bill, including Romney, Ernst, and Sen. Rob Portman (R-Ohio).<\/p>\n<p>The bill will now head to President Joe Biden\u2019s desk for final approval.
