Only House GOP leader Kevin McCarthy, the likely next Speaker of the House, was fighting it all along among the vaunted \u201cFour Corners\u201d\u2013the so-called four leaders of the two chambers of Congress.<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>When Breitbart News broke the story on Monday morning, though, that McCarthy was outvoted three to one among the congressional leaders on this matter, pandemonium broke out among opponents of the JCPA, especially those on the right.<\/p>\n<p>Criticisms rained down on the effort, particularly along the lines that not only did the JCPA policy-wise have nothing to do with America\u2019s national defense, but that in reality the policy would weaken national security through <a href=\"https:\/\/www.breitbart.com\/tech\/2022\/12\/05\/the-jcpa-contains-a-massive-loophole-for-china\/\">loopholes that would boost the chief adversary of the United States the Chinese Communist Party (CCP).<\/a><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Giving the media cartel power is bad enough.<\/p>\n<p>The JCPA&#8217;s &#8220;China loophole&#8221; means this will benefit our adversaries.<\/p>\n<p>All Republicans should oppose cramming this bad bill in the NDAA.<a href=\"https:\/\/t.co\/2SO18ZuDxI\">https:\/\/t.co\/2SO18ZuDxI<\/a><\/p>\n<p>\u2014 Mike Pompeo (@mikepompeo) <a href=\"https:\/\/twitter.com\/mikepompeo\/status\/1600154789559549954?ref_src=twsrc%5Etfw\">December 6, 2022<\/a><\/p>\n<\/blockquote>\n<p>Senate Republicans, meanwhile, began organizing efforts to fight back. Sen. Tom Cotton (R-AR) swung into action and urged his GOP colleagues to filibuster the defense package if it contains the JCPA. Others, like Sens. Mike Lee (R-UT) and Thom Tillis (R-NC), issued public statements via Twitter saying they disagreed with including this in the NDAA.<\/p>\n<blockquote class=\"a8d-pre twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The JCPA has no place in a defense authorization bill. This provision is simply a backroom deal to bail out Big Media for its failed business practices.<\/p>\n<p>\u2014 Senator Thom Tillis (@SenThomTillis) <a href=\"https:\/\/twitter.com\/SenThomTillis\/status\/1600212583096586240?ref_src=twsrc%5Etfw\">December 6, 2022<\/a><\/p>\n<\/blockquote>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>GOP Senators debated the matter behind closed doors, too, in their weekly policy lunch, and the lack of any serious defense of the effort to include the JCPA and other extraneous proposals in the NDAA shocked McConnell as senators expressed outrage on the matter. McConnell, sources familiar with the matter say, began changing his tune in response to the GOP outrage later on Tuesday and insisting the NDAA be stripped of the JCPA.<\/p>\n<p>Meanwhile, other critics of the legislation, like House Judiciary Committee ranking member <a href=\"https:\/\/www.breitbart.com\/tech\/2022\/12\/03\/jim-jordan-slams-jcpa-further-collusion-to-censor-conservatives\/\">Rep. Jim Jordan (R-OH)<\/a> and the House Judiciary GOP threw haymakers against the plan via Twitter, ripping the plot.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">You know what\u2019s a REAL national security issue? <\/p>\n<p>Not being able to meet our military\u2019s recruitment goals because of the <a href=\"https:\/\/twitter.com\/hashtag\/COVID19?src=hash&#038;ref_src=twsrc%5Etfw\">#COVID19<\/a> vaccine mandate on our troops. <\/p>\n<p>Know what isn\u2019t? <\/p>\n<p>A Big Media bailout. <a href=\"https:\/\/t.co\/PKEjqqhlRv\">https:\/\/t.co\/PKEjqqhlRv<\/a><\/p>\n<p>\u2014 House Judiciary GOP (@JudiciaryGOP) <a href=\"https:\/\/twitter.com\/JudiciaryGOP\/status\/1600240217855709185?ref_src=twsrc%5Etfw\">December 6, 2022<\/a><\/p>\n<\/blockquote>\n<p>More voices joined the chorus too, including former President Donald Trump\u2019s eldest son Donald Trump Jr. tweeting out a criticism of the JCPA saying it would lead to more censorship of conservatives and urging Republicans to rip it out of the NDAA.<\/p>\n<blockquote class=\"a8d-pre twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Why are some Republicans working with Dems to destroy alternative media? Strip it out of the NDAA!\u201d<\/p>\n<p>Others, like conservative groups including FreedomWorks and Americans for Tax Reform (ATR), joined the push to strip the JCPA out of the NDAA via tweets and letters.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The JCPA (pure cronyism that runs counter to the idea of an open internet) should not be tagged onto the <a href=\"https:\/\/twitter.com\/hashtag\/NDAA?src=hash&#038;ref_src=twsrc%5Etfw\">#NDAA<\/a>; it should be voted on as a standalone bill. <a href=\"https:\/\/twitter.com\/hashtag\/ampFW?src=hash&#038;ref_src=twsrc%5Etfw\">#ampFW<\/a> \u27a1\ufe0f <a href=\"https:\/\/t.co\/DNidwpdKzy\">https:\/\/t.co\/DNidwpdKzy<\/a> <a href=\"https:\/\/t.co\/D9iYrNi9Y4\">pic.twitter.com\/D9iYrNi9Y4<\/a><\/p>\n<p>\u2014 FreedomWorks (@FreedomWorks) <a href=\"https:\/\/twitter.com\/FreedomWorks\/status\/1600249269574852628?ref_src=twsrc%5Etfw\">December 6, 2022<\/a><\/p>\n<\/blockquote>\n<p><em>Reason<\/em> magazine, the voice of the libertarian movement in the U.S., <a href=\"https:\/\/reason.com\/2022\/12\/06\/cronyist-journalism-measure-could-prompt-facebook-to-ban-news\/\">also came out against the bill<\/a>, echoing FreedomWorks\u2019 characterization of the JCPA as \u201ccronyism.\u201d<\/p>\n<p>\u201cThe worst ideas in Congress never die; they just get sneaked into unrelated bills,\u201d wrote <em>Reason\u00a0<\/em>senior editor Elizabeth Nolan Brown. \u201cThis week, that means lawmakers are reportedly trying to burrow a bad media protectionism bill into defense spending authorization.\u201d<\/p>\n<p>Other organizations on the center right, including the Niskanen Center and R Street Institute,\u00a0<a href=\"https:\/\/publicknowledge.org\/policy\/group-letter-to-congressional-leadership-against-jcpas-ndaa-inclusion\/\">signed on to an open letter<\/a> opposing the last-ditch JCPA effort with 25 other organizations from across the political spectrum.<\/p>\n<p>Given that populists like Sen. Josh Hawley (R-MO), whose populist politics are often a source of consternation for libertarians, <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/09\/06\/exclusive-senator-josh-hawley-opposes-media-cartel-plan\/\">also opposed the JCPA over its weakening of antitrust laws<\/a>, it looks like every part of the political right has a reason to oppose this bill.<\/p>\n<p>Over at Fox News, Laura Ingraham, host of\u00a0<em>The Ingraham Angle,\u00a0<\/em>called the push to add the JCPA to a defense spending bill \u201cdisturbing.\u201d<\/p>\n<p>\u201cNow this defense bill will as usual be so long, and the text released so late that few members will actually read it, and even fewer tally up all the waste,\u201d said Ingraham. She went on to say:<\/p>\n<blockquote>\n<p>But Breitbart uncovered something disturbing tucked inside it \u2013 something called the Journalism Competition and Preservation Act in the National Defense Authorization Act. Now, it will allow media companies \u2013 most owned by wealthy conglomerates \u2013 to form negotiating cartels to secure special favors from Big Tech companies, including some financial handouts.<\/p>\n<p>Don\u2019t for a second think that they hadn\u2019t planned this all. Staff on the hill and at the White House have undoubtedly been working away at all of this nonsense for probably most of the last year.<\/p>\n<\/blockquote>\n<p>Meta\u2019s Mark Zuckerberg also waded into the fray, <a href=\"https:\/\/www.breitbart.com\/tech\/2022\/12\/05\/facebook-warns-it-may-remove-all-news-from-platform-over-jcpa\/\">releasing a statement on Monday<\/a> warning that Facebook may have to remove news from the platform altogether if the alternative is to be forced into binding agreements with a corporate media cartel as the result of the JCPA.<\/p>\n<p>Even the left is up in arms about the bill. Despite attempts by media lobbyists to frame the bill as a rescue package for struggling journalists, the media unions who represent those journalists were not convinced, <a href=\"https:\/\/www.breitbart.com\/tech\/2022\/12\/02\/media-union-boss-slams-jcpa-as-handout-for-hedge-funds\/\">slamming the JCPA as a handout for the hedge fund owners of media conglomerates<\/a>, not frontline journalists.<\/p>\n<p>This argument was echoed by the left-leaning nonprofits, including the influential ACLU, <a href=\"https:\/\/www.breitbart.com\/tech\/2022\/12\/05\/progressives-including-aclu-blast-pelosi-over-jcpa-handout-to-hedge-funds\/\">over 25 of which signed on to an open letter on Monday<\/a> opposing the attachment of the JCPA to the NDAA.<\/p>\n<p>From the open letter:<\/p>\n<blockquote>\n<p>Large media conglomerates can dominate negotiations, and small outlets would be unheard if not hurt,\u201d wrote the organizations in their open letter.\u00a0Despite claims that the bill is \u2018designed to benefit small and local publishers exclusively,\u2019 a publisher employee cap of 1,500 would exclude only the nation\u2019s three largest newspapers from participating in negotiations (and as noted below, the cap doesn\u2019t apply to broadcasters at all).<\/p>\n<p>The \u201cone publisher, one vote\u201d provision for negotiating entities underplays the forms of soft power large conglomerates with brand-name news outlets can bring to the negotiations. In fact, the bill encourages \u2014 and may help fund \u2014 more consolidation among both newspapers and broadcasters.<\/p>\n<\/blockquote>\n<p>No matter where you look on the ideological compass \u2013 left, right, MAGA, moderate, populist, libertarian \u2013we find vocal opposition to the JCPA, and bipartisan agreement that the bill is nothing more than corporate welfare for the world\u2019s wealthiest media companies and their hedge fund owners. It seems the only friends the media industry and its well-funded lobbyists have are their lackeys in Congress.<\/p>\n<p>From here, the path forward for the JCPA is unclear. Now that it is out of the NDAA, leaders could try to attach it to a spending bill like an omnibus or a continuing resolution (CR)\u2013an omnibus is a far likelier place than a CR for something like this\u2013or they could try to pass it as a standalone bill.
