(Michael Ciaglo for The Epoch Times)<\/p>\n<\/p><\/div>\n<div>\n<p>A Texas federal judge has ordered <a href=\"https:\/\/www.theepochtimes.com\/t-southwest-airlines\">Southwest Airlines<\/a> to reinstate Charlene Carter, the flight attendant who made headlines after a jury ruled that she was unlawfully fired for expressing pro-life views and for criticizing her union.<\/p>\n<p>In a decision filed on Dec. 5, five months after a jury decided in Carter\u2019s favor, Judge Brantley Starr remarked, \u201cBags fly free with Southwest. But free speech didn\u2019t fly at all with Southwest in this case.\u201d<\/p>\n<p>Starr granted Carter $300,000 in compensatory and punitive damages from Southwest; $300,000 in compensatory and punitive damages from the flight attendants\u2019 union,\u00a0Transport Workers Union of America Local 556; $150,000 in back pay, and $60,180.82 in prejudgment interest.<\/p>\n<p>Although the jury voted that Carter deserved more than $5 million, laws and rules limit the amount that can be awarded in such cases.<\/p>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>\u201cThe jury also awarded front [or future] pay, but Carter would rather have her job back,\u201d the judge wrote. \u201cThe Court reinstates Carter to her former position \u2026 If the Court opted for front pay over reinstatement, the court would complete Southwest\u2019s unlawful scheme. Reinstatement is appropriate.\u201d<\/p>\n<p>Further, the judge explicitly ordered Southwest and Local 556 to share the jury\u2019s verdict and Starr\u2019s decision with all members of the union via email and to post the documents in conspicuous places for a 60-day period.<\/p>\n<p>Starr\u2019s order also forbids both the company and the union \u201cfrom discriminating against Southwest flight attendants for their religious practices and beliefs, including\u2014but not limited to\u2014those expressed on social media and those concerning <a href=\"https:\/\/www.theepochtimes.com\/t-abortion\">abortion<\/a>.\u201d<\/p>\n<p>Southwest and Local 556 are required to inform employees that federal law prohibits such discrimination.<\/p>\n<p>Both entities also must \u201creasonably accommodate\u00a0Southwest flight attendants\u2019 sincerely held religious beliefs, practices, and observances,\u201d Starr wrote.<\/p>\n<p>The judge\u2019s rulings and rationale are contained in three documents totaling 43 pages in U.S. District Court for the Northern District of Texas, Dallas Division.<\/p>\n<\/div>\n<div class=\"column\">\n<p>Carter, who now lives in Colorado, fought for five years after she was fired. As The Epoch Times<a href=\"https:\/\/www.theepochtimes.com\/the-untold-story-of-the-flight-attendant-fired-for-expressing-pro-life-views_4671438.html\"> previously reported, <\/a>Carter had become an outspoken opponent of abortion after she suffered physical and emotional effects from terminating a pregnancy years earlier, when she was 19.<\/p>\n<p>In 2017, Carter sent private Facebook messages to Audrey Stone, then president of Local 556, railing against the union\u2019s participation in the national Women\u2019s March.<\/p>\n<p>It was an event sponsored, in part, by Planned Parenthood, a pro-abortion group.<\/p>\n<p>Stone complained to Southwest about Carter\u2019s messages.
