Here&#8217;s how<\/a><\/p>\n<p>&#8220;The U.S. Supreme Court is more likely than not to block the president&#8217;s student loan forgiveness plan,&#8221; Kantrowitz said.<\/p>\n<p>The highest court decided to take the case after the U.S. Department of Justice filed an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22A444\/246931\/20221118113829714_Nebraska%20Vacatur%20Application%20FINAL.pdf\" target=\"_blank\" rel=\"noopener\">emergency application<\/a>\u00a0asking the justices to lift\u00a0<a href=\"https:\/\/int.nyt.com\/data\/documenttools\/8th-cir\/62dc208df2a6972c\/full.pdf\" target=\"_blank\" rel=\"noopener\">the injunction<\/a> on its forgiveness plan that had been issued by the U.S. Court of Appeals for the 8th Circuit, in St. Louis, at the request of six GOP-led states.<\/p>\n<p>The justices, who will decide whether or not <a href=\"https:\/\/www.supremecourt.gov\/qp\/22-00506qp.pdf\" target=\"_blank\" rel=\"noopener\">the president&#8217;s debt relief policy causes harm to the plaintiffs or is an overreach of executive authority<\/a>, said they would hear oral arguments in February.<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\">Ruling will settle &#8216;for now&#8217; student loan challenges<\/h2>\n<div class=\"group\">\n<p>In August, Preisdent Joe Biden\u00a0<a href=\"https:\/\/www.cnbc.com\/2022\/08\/24\/biden-expected-to-cancel-10000-in-federal-student-loan-debt-for-most-borrowers.html\">announced<\/a>\u00a0that the U.S. Department of Education would deliver student loan forgiveness of up to $20,000 for tens of millions of Americans. The nonpartisan Congressional Budget Office estimates the plan will cost around <a href=\"https:\/\/www.cbo.gov\/system\/files\/2022-09\/58494-Student-Loans.pdf\" target=\"_blank\" rel=\"noopener\">$400 billion<\/a>.<\/p>\n<p>Long before the president acted, <a href=\"https:\/\/www.businessinsider.com\/student-loan-debt-forgiveness-not-solution-higher-education-costs-gop-2022-3\" target=\"_blank\" rel=\"noopener\">Republicans had criticized student loan forgiveness<\/a>\u00a0as a handout to well-off college graduates. They also argued the president didn&#8217;t have the power to forgive consumer debt on his own without authorization from Congress.<\/p>\n<p>Unsurprisingly,\u00a0<a href=\"https:\/\/thecollegeinvestor.com\/41091\/legal-challenges-to-student-loan-forgiveness-plan\/\" target=\"_blank\" rel=\"noopener\">the legal challenges poured in<\/a>. He said the conservative justices believe government agencies exert too much authority and &#8220;violate the separation of powers.&#8221; In addition, he said, the concept of loan forgiveness seems to run counter to their notions of individual responsibility.<\/p>\n<p>Such a politically fueled decision, however, is likely to further damage the public&#8217;s perception of the Supreme Court, Urman said.<\/p>\n<p>&#8220;Striking down forgiveness will add to growing skepticism that the conservative justices vote for conservatives, and the liberal justices vote for liberals,&#8221; Urman said. Just 25% of Americans have confidence in the highest court, a Gallup poll <a href=\"https:\/\/news.gallup.com\/poll\/394103\/confidence-supreme-court-sinks-historic-low.aspx\" target=\"_blank\" rel=\"noopener\">found<\/a> over the summer.<\/p>\n<\/div>\n<blockquote data-test=\"Pullquote\">\n<div class=\"Pullquote-pullquote\">\n<div>\n<div class=\"Pullquote-quote\">Striking down forgiveness will add to growing skepticism that the conservative justices vote for conservatives.<\/div>\n<div class=\"Pullquote-sourceWrapper\">\n<div class=\"Pullquote-info\">a law professor at Northeastern University<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/blockquote>\n<div class=\"group\">\n<p>If the president&#8217;s plan is blocked, he added, it will be &#8220;<a href=\"https:\/\/urldefense.com\/v3\/__https:\/thehill.com\/homenews\/administration\/3623055-majority-backs-student-loan-debt-relief-poll\/__;!!PIZeeW5wscynRQ!sJborZ5ZEyFkZX62QZNdW_5tcsbot-fVVYYwKlXUUMcPEHVSH-6xs7DtT-rQ7LgIEEjB2AGJ8R8-8KkiuxhdrH59$\" target=\"_blank\" rel=\"noopener\">another example<\/a>, along with abortion and guns, of the court taking positions that a majority of Americans oppose.&#8221;<\/p>\n<p>In a poll conducted by The Economist and YouGov in August, <a href=\"https:\/\/thehill.com\/homenews\/administration\/3623055-majority-backs-student-loan-debt-relief-poll\/\" target=\"_blank\" rel=\"noopener\">51% of respondents said they support Biden&#8217;s loan relief plan<\/a>. Around 40% oppose the initiative.<\/p>\n<p>&#8220;In the past, the Supreme Court usually ruled in line with public opinion,&#8221; Urman said.<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\">Arguments over the limit of presidential power<\/h2>\n<div class=\"group\">\n<p>Beyond the popularity of its debt relief plan, the Biden administration insists that it&#8217;s acting within the law, pointing out that the Heroes Act of 2003 grants the education secretary the authority to waive regulations related to student loans during national emergencies.
