Elenis,<\/em> which involves Lorie Smith, a web designer from Colorado who is a Christian. She is claiming that the Colorado Anti-Discrimination Act (CADA) <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/303-creative-llc-v-elenis\/\" target=\"_blank\" rel=\"noopener\">violates<\/a> her First Amendment freedom of speech and free exercise of religion rights. Smith has not <a href=\"https:\/\/www.cnn.com\/2022\/12\/05\/politics\/supreme-court-same-sex-couples-lorie-smith\/index.html\" target=\"_blank\" rel=\"noopener\">started<\/a> creating wedding websites over fear of breaking a law in Colorado that prohibits discrimination. She wants to post a message saying she won\u2019t make websites for same-sex couples due to her religious beliefs. However, CADA <a href=\"https:\/\/ballotpedia.org\/303_Creative_LLC_v._Elenis\" target=\"_blank\" rel=\"noopener\">makes<\/a> it so that businesses cannot discriminate against certain individuals or say they are going to do so.<\/p>\n<p class=\"p1\">The justices heard arguments for the case at the Supreme Court on Monday and several of them asked questions about hypothetical situations when it comes to this issue.\u00a0<\/p>\n<p class=\"p1\">\u201cLet\u2019s just say that [The New York Times] for Gay Pride Month decides that it\u2019s going to run \u2014 to promote and recognize same sex marriage \u2014 only same sex marriage announcements, turns away heterosexual announcements, not because it disparages or disagrees with opposite-sex unions but because it\u2019s trying to promote something else,\u201d Justice Amy Coney Barrett <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/3762400-conservative-justices-signal-support-for-web-designer-opposed-to-same-sex-marriage\/\" target=\"_blank\" rel=\"noopener\">said<\/a>.\u00a0<\/p>\n<p class=\"p1\">\u201cCan it do that?\u201d she asked Colorado Solicitor General Eric Olson. \u201cThat\u2019s a protected characteristic under the law?\u201d<\/p>\n<p class=\"p1\">\u201cI think the answer is no,\u201d Olson answered after discussing it.<\/p>\n<p class=\"p1\">Justice Clarence Thomas spoke about the use of public accommodations laws.\u00a0<\/p>\n<p class=\"p1\">\u201c[T]he complicating factor here \u2014 fact here is this is not a hotel, this is not a restaurant, this is not a riverboat or a train. I\u2019m interested in the intersection of public accommodations law and speech,\u201d he said.\u00a0<\/p>\n<p>Justice Neil Gorsuch asked about the content factor of the issue, questioning, \u201cthe objections to compelled speech on religious grounds could include, in fact, do include, some objections with respect to certain heterosexual marriages, that there are certain heterosexual unions that your client would not speak toward either, is that correct?\u201d<\/p>\n<p>\u201cCertainly, and that\u2019s in the stipulated facts in terms of she declines messages based on the message, and she has declined other projects based on the message that have nothing to do with same-sex marriage,\u201d Kristen Waggoner, Smith\u2019s attorney said.<\/p>\n<p>\u201cSo the question isn\u2019t who, it\u2019s what?\u201d Gorsuch asked.<\/p>\n<p>\u201cAlways,\u201d Waggoner responded.<\/p>\n<p class=\"p1\">Justice Brett Kavanaugh asked about how a ruling might impact the profession of speechwriting.\u00a0<\/p>\n<p class=\"p1\">\u201cSo I\u2019m trying to figure out given what you say there how you would say this case does not involve the same thing as a writer being forced to write speeches that violate their most deeply held convictions,\u201d Kavanaugh <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2022\/21-476_8n59.pdf\" target=\"_blank\" rel=\"noopener\">asked<\/a> Deputy Solicitor General Brian Fletcher, who was arguing for Colorado\u2019s law.\u00a0<\/p>\n<p class=\"p1\">Justice Ketanji Brown Jackson <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/12\/05\/colorado-creative-supreme-court-lgbtq\/\" target=\"_blank\" rel=\"noopener\">discussed<\/a> a scenario where a holiday photographer in a mall could refuse to include children of color in photos if they are trying to create \u201cfeelings of a certain era.\u201d<\/p>\n<p class=\"p1\">Justice Alito then posed a question furthering the debate, asking, \u201cJustice Jackson\u2019s example of the \u2014 the Santa in the mall who doesn\u2019t want his picture taken with black children, so if there\u2019s a \u2014 a black Santa at the other end of the mall and he doesn\u2019t want to have his picture taken with a child who\u2019s dressed up in a Ku Klux Klan outfit, that \u2014 that black Santa has to do that?\u201d<\/p>\n<p class=\"p1\">\u201cNo, because Ku Klux Klan outfits are not protected characteristics under public accommodation laws,\u201d Olson responded.\u00a0<\/p>\n<p class=\"p1\">\u201cHow about people who don\u2019t believe in interracial marriage?\u201d Justice Sonia Sotomayor <a href=\"https:\/\/www.cnn.com\/2022\/12\/05\/politics\/supreme-court-same-sex-couples-lorie-smith\/index.html\" target=\"_blank\" rel=\"noopener\">asked<\/a>. \u201cOr about people who don\u2019t believe that disabled people should get married? Where\u2019s the line?\u201d<\/p>\n<p class=\"p1\">The Supreme Court refused to hear the argument that the Colorado measure violates Smith\u2019s religious freedom when it decided to take on the case. It also refused to listen to Smith\u2019s desire to alter Supreme Court precedent on neutral laws that might impact religious people.\u00a0<\/p>\n<p class=\"p1\">The justices did, however, <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/12\/05\/colorado-creative-supreme-court-lgbtq\/\" target=\"_blank\" rel=\"noopener\">agree<\/a> to answer the question of \u201c[w]hether applying a public-accommodation law to compel an artist to speak or stay silent violates the Free Speech Clause of the First Amendment.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a Supreme Court case heard on Monday, conservative justices appeared to lean in favor of a Christian website designer, questioning how certain rules would apply in different scenarios.\u00a0 The case is 303 Creative v.
