They argued that the \u201cextraordinary\u201d circumstances standard \u201cguards against needless judicial intrusion into the course of criminal investigations \u2014 a sphere of power committed to the executive branch.\u201d<\/p>\n<p>The panel included George W. Bush appointee William Pryor, as well as two judges appointed during Trump\u2019s tenure in office, <a href=\"https:\/\/www.axios.com\/2022\/12\/01\/trump-mar-a-lago-special-master\">according<\/a> to Axios.<\/p>\n<p>Cannon\u2019s order from early September <a href=\"https:\/\/www.forbes.com\/sites\/insider\/2022\/09\/09\/do-special-masters-really-trump-taint-teams-heres-a-better-option\/?sh=18412be52ad9\">appointed<\/a> a special master to determine if any of the over 11,000 documents taken from Mar-a-Lago fell under executive privilege. He was also given the power to serve as a mediator between the DOJ and Trump.<\/p>\n<p>Trump\u2019s legal team argued that a special master was necessary because some of the documents seized by the FBI were protected by executive privilege or attorney-client privilege, because Trump had the power to declassify the documents, and because the DOJ\u2019s own dedicated privilege team did not have adequate \u201cprotocols\u201d for this case, according to the ruling.<\/p>\n<p>Cannon <a href=\"https:\/\/www.dailywire.com\/news\/judge-names-trump-pick-for-special-master-denies-doj-request-to-limit-review\">appointed<\/a> Raymond Dearie, a senior U.S. district judge for the Eastern District of New York, to serve as special master in the case after Trump\u2019s team proposed his appointment and the DOJ agreed.<\/p>\n<p>Trump\u2019s legal team has reportedly not yet decided whether to appeal the ruling.<\/p>\n<p>The court\u2019s ruling removes a barrier to the DOJ\u2019s criminal investigation into whether Trump mishandled classified U.S. government records.<\/p>\n<p>The DOJ <a href=\"https:\/\/www.dailywire.com\/news\/trump-responds-to-doj-tapping-special-counsel-to-handle-two-of-its-criminal-investigations-into-him\">announced<\/a> on November 18 that Jack Smith, who has spent years at the International Criminal Court in The Hague prosecuting war crimes, will serve as the special counsel overseeing two of the department\u2019s criminal investigations into Trump \u2014 including the investigation into the Mar-a-Lago documents.<\/p>\n<p>Trump told Fox News in an exclusive interview after the announcement that he would not \u201cpartake in\u201d the investigation.<\/p>\n<p>\u201cIt is unfair to the country, to the Republican Party, and I don\u2019t think people should accept it,\u201d he added. \u201cI am not going to accept it.\u201d<\/p>\n<p>Trump then asked why a special prosecutor had not been appointed in the DOJ\u2019s criminal investigation of Hunter Biden.<\/p>\n<p>\u201cWhy isn\u2019t there a special counsel being set up for them?\u201d Trump asked of Hunter and his father, President Joe Biden. \u201cTremendous corruption, they\u2019re corrupt people, they\u2019re criminals. I\u2019ve done nothing wrong.
