In October, Brinton was charged with stealing a suitcase worth $2,325 from a baggage carousel at the Minneapolis St. Paul Airport.<\/p>\n<p>&#8220;Sam Brinton is on leave from DOE, and Dr. Kim Petry is performing the duties of Deputy Assistant Secretary of Spent Fuel and Waste Disposition,&#8221; a DOE spokesperson told Fox News Digital in a statement earlier this week.<\/p>\n<p>Fox News Digital contacted the DOE multiple times Thursday but did not receive a response about whether Brinton continued to receive a government paycheck despite the outstanding charges.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/biden-non-binary-nuclear-official-charged-stealing-womans-luggage-airport\" target=\"_blank\" rel=\"noopener\"><strong>NON-BINARY BIDEN NUCLEAR OFFICIAL CHARGED WITH STEALING WOMAN&#8217;S LUGGAGE AT AIRPORT<\/strong><\/a><\/p>\n<div class=\"image-ct inline\">\n<div class=\"m\"><source media=\"(max-width: 767px)\" \/><source media=\"(min-width: 767px) and (max-width: 1023px)\" \/><source media=\"(min-width: 1024px) and (max-width: 1279px)\" \/><source media=\"(min-width: 1280px)\" \/><img decoding=\"async\" src=\"https:\/\/a57.foxnews.com\/static.foxnews.com\/foxnews.com\/content\/uploads\/2022\/11\/640\/320\/SAM-BRINTON-PORTRAIT.jpg?ve=1&#038;tl=1\" alt=\"Brinton&#039;s official government portrait\" \/><\/div>\n<div class=\"caption\">\n<p>\n      Brinton&#8217;s official government portrait<br \/>\n      <span class=\"copyright\">(Department of Energy)<\/span><\/p>\n<\/div>\n<\/div>\n<p>Brinton, who is also one of the federal government&#8217;s first-ever officials <a href=\"https:\/\/www.foxnews.com\/world\/world-health-organization-updates-gender-guide-beyond-non-binary\" target=\"_blank\" rel=\"noopener\">to identify as non-binary<\/a>, allegedly took the luggage after traveling from Washington, D.C., on Sept. 16, according to a criminal complaint filed on Oct. 26 in Minnesota state court. Security camera footage of the incident reviewed by law enforcement showed Brinton taking the bag from carousel before removing its tag and hurrying away.<\/p>\n<p>Weeks after the incident, Brinton confirmed having the bag <a href=\"https:\/\/www.foxnews.com\/category\/us\/crime\" target=\"_blank\" rel=\"noopener\">when a police officer called<\/a> to discuss the matter. However, the DOE official denied any wrongdoing.<\/p>\n<p>&#8220;If I had taken the wrong bag, I am happy to return it, but I don\u2019t have any clothes for another individual,&#8221; Brinton told the officer. &#8220;That was my clothes when I opened the bag.&#8221;<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/special-counsel-biden-energy-secretary-violated-hatch-act\" target=\"_blank\" rel=\"noopener\"><strong>SPECIAL COUNSEL RULES BIDEN&#8217;S ENERGY SECRETARY VIOLATED HATCH ACT<\/strong><\/a><\/p>\n<p>In a call two hours later, Brinton apologized to the officer for not being &#8220;completely honest&#8221; but said the bag was taken due to tiredness. Brinton is slated to appear during a court hearing on Dec. 19 in relation to the case.<\/p>\n<p>Brinton&#8217;s lawyer did not respond to a request for comment.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/apps-products?pid=AppArticleLink\" target=\"_blank\" rel=\"noopener\"><strong><u>CLICK HERE TO GET THE FOX NEWS APP<\/u><\/strong><\/a><\/p>\n<p>Brinton had received attention in June after being appointed to the DOE&#8217;s Office of Nuclear Energy for being non-binary.
