Chip Roy of Texas, mirrors word for word the protections that Republican Sen. Mike Lee <a href=\"https:\/\/www.lee.senate.gov\/services\/files\/CB39DE23-EF22-4CDC-B645-BF756A5F94D1\" target=\"_blank\" rel=\"noreferrer noopener\">tried to add<\/a> to the Senate\u2019s version of the bill.<\/p>\n<p>The current RFMA reaches beyond the Supreme Court\u2019s\u00a0<em>Obergefell v. Hodges<\/em>\u00a0decision to make a private right of action for anyone who wants to sue Americans opposed to same-sex marriage. It also allows the Department of Justice, which faces severe scrutiny for politicization under Attorney General Merrick Garland, to go after religious Americans for their beliefs about marriage. <\/p>\n<p>If Roy\u2019s amendment passes the House, it will explicitly prohibit the federal government from taking \u201cany discriminatory action against a person, wholly or partially on the basis that such person speaks, or acts, in accordance with a sincerely held religious belief, or moral conviction\u201d that marriage is between one man and woman. The amendment also would give Americans\u2019 who are targeted by the government for their beliefs about marriage a right to sue.<\/p>\n<p>While Lee\u2019s amendment failed to meet the 60-vote threshold his colleagues set, the amendment from Roy and his Republican cosponsors Reps. Byron Donalds and Doug Lamborn will serve as a litmus test for conservative legislators who say they prioritize Americans\u2019 First Amendment rights.<\/p>\n<p>Despite the RFMA\u2019s flaws, <a href=\"https:\/\/thefederalist.com\/2022\/07\/22\/as-with-jumping-off-a-cliff-so-with-supporting-same-sex-marriage-dont-just-follow-the-majority\/\" target=\"_blank\" rel=\"noreferrer noopener\">47<\/a> Republican representatives voted to pass the legislation when it made its way through the House in July. <\/p>\n<p>When the bill arrived in the Senate, Roy, along with legal scholar Ryan T. Anderson, <a href=\"https:\/\/www.foxnews.com\/opinion\/defending-marriage-will-senate-republicans-display-courage-uphold-truth\">penned an opinion editorial<\/a> warning Republican senators that the RFMA\u2019s \u201clip service to religious liberty and conscience rights\u201d does nothing to stop vindictive leftists from \u201cdragging good people through the court system and a public tarring and feathering in the media for those simply living their lives in\u00a0fidelity to God.\u201d<\/p>\n<p>Those \u201cgood people\u201d include\u00a0<a href=\"https:\/\/downloads.frc.org\/EF\/EF16L23.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wedding vendors<\/a>,\u00a0<a href=\"https:\/\/www.nationalreview.com\/2018\/10\/faith-based-adoption-agencies-under-attack-beto-orourke\/\" target=\"_blank\" rel=\"noreferrer noopener\">adoption agencies<\/a>,\u00a0<a href=\"https:\/\/thefederalist.com\/tag\/jack-phillips\/\" target=\"_blank\" rel=\"noreferrer noopener\">bakeries<\/a>, and any other business run by people of faith who refuse to offer services condoning same-sex marriage based on religious convictions. <\/p>\n<p>Together, Roy and Anderson <a href=\"https:\/\/twitter.com\/chiproytx\/status\/1596506341169831936?s=20&#038;t=YxBH2mIBKm9hNzqzvPzMcw\" target=\"_blank\" rel=\"noreferrer noopener\">urged at least three<\/a> of the 12 Republicans who voted to advance the bill to reconsider supporting it in its final passage. But to no avail.<\/p>\n<p>Despite problems raised by <a href=\"https:\/\/thefederalist.com\/2022\/11\/28\/their-constituents-oppose-the-gay-marriage-bill-so-whom-do-these-12-gop-senators-think-theyre-representing\/\" target=\"_blank\" rel=\"noreferrer noopener\">Republican voters<\/a>, legal organizations, churches, and religious liberty groups, the RFMA <a href=\"https:\/\/thefederalist.com\/2022\/11\/29\/12-gop-senators-help-democrats-erode-americans-right-to-act-on-religious-convictions-about-marriage\/\" target=\"_blank\" rel=\"noreferrer noopener\">passed<\/a> the upper chamber with the support of those same 12 GOP senators.<\/p>\n<p>Shortly after that vote, Roy took to Twitter to urge his House GOP colleagues to vote no \u201con a bill that demonstrably exposes Americans to persecution for closely held religious beliefs, in addition to attacking marriage.\u201d<\/p>\n<p>Rep. Kevin McCarthy, who will likely assume the position of House speaker in January, already signaled his belief that this legislation should not be passed as is. <\/p>\n<p>McCarthy told reporters early on Tuesday that he agrees with the U.S. Conference of Catholic Bishops<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Roy&#8217;s amendment mirrors word for word the protections that Republican Sen.
