takes effect on Saturday in New York that supposedly targets hateful speech online. But it may not last long, because the state just got <a href=\"https:\/\/www.thefire.org\/news\/lawsuit-new-york-cant-target-protected-online-speech-calling-it-hateful-conduct\" class=\"stylish-link\"><span class=\"s1\">hit with a First Amendment lawsuit<\/span><\/a> that could bring about the demise of its new regulation.<\/p>\n<p class=\"p3\">The <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/A7865\" class=\"stylish-link\"><span class=\"s1\">law<\/span><\/a> in question is called \u201cSocial media networks; hateful conduct prohibited.\u201d It targets internet platforms and mandates that they publish a policy outlining how they handle \u201chateful\u201d content. It defines \u201chateful conduct\u201d as online speech that serves to \u201cvilify, humiliate, or incite violence against a group or a class of persons\u201d on the basis of protected characteristics.<\/p>\n<p class=\"p3\">The law mandates that internet platforms address reports of such content. Companies that fail to do so face fines of up to $1,000 per day.<\/p>\n<p class=\"p3\">But what about companies that don\u2019t want to play speech-police on their platforms?<\/p>\n<p class=\"p3\">Well, the Foundation for Individual Rights and Expression (FIRE) is suing New York on behalf of independent content platforms Rumble and Locals as well as legal blogger Eugene Volokh.<\/p>\n<p class=\"p3\">\u201c<b>New York politicians are slapping a speech-police badge on my chest because I run a blog<\/b>,\u201d plaintiff Eugene Volokh, co-founder of the Volokh Conspiracy blog, said. \u201cI started the blog to share interesting and important legal stories, <b>not to police readers\u2019 speech at the government\u2019s behest<\/b>.\u201d<\/p>\n<p class=\"p3\">The law\u2019s text <i>says<\/i> it shouldn\u2019t be construed to infringe on anyone\u2019s free speech rights, but FIRE says its policy mandates are themselves a violation of the First Amendment.<\/p>\n<p class=\"p3\">\u201cThe state of New York can\u2019t turn bloggers into Big Brother, but it\u2019s trying to do just that,\u201d said FIRE attorney Daniel Ortner. \u201cThe government can\u2019t burden online expression protected by the Constitution, whether it\u2019s doing it in the name of combating hate or any other sentiment. Imagine a similar law requiring sites to publish a reporting policy for speech the state considers un-American \u2014 that would be just as unconstitutional.\u201d<\/p>\n<p class=\"p3\">Meanwhile, it\u2019s not clear what, if any, good this law would actually accomplish. It seems like little more than an attempt to cajole companies and platforms into further censoring speech disfavored by progressives.<\/p>\n<p class=\"p3\">Here\u2019s hoping it meets its demise in court. But that won\u2019t be the end of the story.<\/p>\n<p class=\"p3\">Unfortunately, this law seems like it\u2019s just one piece of a broader pattern wherein New York\u2019s state government hopes to wage war on \u201chateful\u201d speech\u2014even though it\u2019s constitutionally protected. Don\u2019t forget that the governor, Kathy Hochul, <a href=\"https:\/\/www.based-politics.com\/2022\/05\/16\/kathy-hochul-new-york-governor-falsely-claims-hate-speech-isnt-free-speech\/\" class=\"stylish-link\"><span class=\"s1\">falsely claimed that \u201chate speech\u201d isn\u2019t protected by the First Amendment<\/span><\/a>. Meanwhile, New York Attorney General Letitia James has proposed a variety of regulations seeking to clamp down on ideas the government has deemed harmful.<\/p>\n<p class=\"p3\">So, no matter how this case turns out, it\u2019s clear that the legal battle between those who believe in free speech and those who want to suppress it is just beginning.<\/p>\n<p class=\"p1\"><b>Like this article?
