It refused to do so on Wednesday, keeping Pittman\u2019s ruling in place as the court issues a broader <a href=\"https:\/\/www.npr.org\/2022\/12\/01\/1140070164\/student-debt-relief-appeal-rejected\" target=\"_blank\" rel=\"noopener\">ruling<\/a> on the Biden administration\u2019s appeal. The court <a href=\"https:\/\/www.foxnews.com\/politics\/student-loans-relief-5th-circuit-court-rejects-bidens-latest-plea-reinstate-program\" target=\"_blank\" rel=\"noopener\">decided<\/a> to accelerate the case\u2019s timeline, however, to the \u201cnext available\u201d oral argument.<\/p>\n<p class=\"p1\">The U.S. Court of Appeals for the 8th Circuit also recently ruled against Biden\u2019s student loan forgiveness plan, putting forward an injunction that halted it. The ruling came after a group of six Republican-led states requested the court pause any debt forgiveness during its court proceedings.<\/p>\n<p class=\"p1\">The Biden administration argues that it has the legal authority for its proposal due to the 2003 Higher Education Relief Opportunities for Students Act (<a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1412\/text\" target=\"_blank\" rel=\"noopener\">HEROES<\/a>). The law allows the Education Secretary to get rid of or alter student loan debt in times of war and national emergencies for specific individuals.<\/p>\n<p>Last month, the Biden administration took steps to <a href=\"https:\/\/www.dailywire.com\/news\/biden-administration-asks-supreme-court-to-allow-student-loan-forgiveness-plan\" target=\"_blank\" rel=\"noopener\">ask<\/a> the Supreme Court to weigh in on the plan and let it resume.<\/p>\n<p>In the filing to the Supreme Court, U.S. Solicitor General Elizabeth B. Prelogar discussed the HEROES Act.<\/p>\n<p>\u201cBecause borrowers who default on their student loans face severe financial consequences \u2014 including wage garnishment, long-term credit damage, and ineligibility for federal benefits \u2014 Congress specifically authorized the Secretary to waive or modify any applicable statutory or regulatory provision as he deems necessary to ensure that borrowers affected by a national emergency are not worse off in relation to their student loans,\u201d she <a href=\"https:\/\/docs-cdn-prod.news-engineering.aws.wapo.pub\/publish_document\/7d1b7c7e-5b8b-4ba9-a353-91426075f82a\/published\/7d1b7c7e-5b8b-4ba9-a353-91426075f82a.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a>.<\/p>\n<p class=\"p1\">The states involved in the legal case in the 8th Circuit disagree with the use of HEROES.<\/p>\n<p class=\"p1\">\u201cThe Act requires a real connection to a national emergency. But the Department\u2019s reliance on the\u00a0COVID-19 pandemic\u00a0is a pretext to mask the President\u2019s true goal of fulfilling his campaign promise to erase student-loan debt,\u201d the states wrote.<\/p>\n<p class=\"p1\">\u201cHiding the real motive, the agency attempts to connect the Cancellation to the pandemic by citing current economic conditions supposedly caused by COVID-19. But those conditions are not directly attributable to the pandemic, so the Department has failed to adequately link the Cancellation to a national emergency,\u201d they added.<\/p>\n<p class=\"p1\">The plan involves giving up to $10,000 in debt cancellation to qualifying student loan borrowers who make under $125,000 as individuals or $250,000 as a household. People who received Pell Grants could receive up to $20,000 in debt cancellation.<\/p>\n<p>Prior to the legal challenges, the Department of Education had <a href=\"https:\/\/www.npr.org\/2022\/11\/10\/1135940851\/student-debt-relief-biden-blocked-texas-district-court\" target=\"_blank\" rel=\"noopener\">greenlit<\/a> millions of requests for debt relief. The White House <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/11\/03\/by-the-numbers-millions-of-americans-student-loan-costs-will-rise-dramatically-under-republican-officials-plans\/\" target=\"_blank\" rel=\"noopener\">announced<\/a> in November that almost 26 million people had applied and around 16 million applications were set to be approved.<\/p>\n<p class=\"p1\">The\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/bidens-student-loan-cancellation-plan-cost-400b-congressional-budget-o-rcna49478\" target=\"_blank\" rel=\"noopener\">nonpartisan<\/a>\u00a0Congressional Budget Office\u00a0<a href=\"https:\/\/www.cbo.gov\/system\/files\/2022-09\/58494-Student-Loans.pdf\" target=\"_blank\" rel=\"noopener\">estimated<\/a>\u00a0that Biden\u2019s student loan forgiveness will\u00a0<a href=\"https:\/\/www.washingtonpost.com\/us-policy\/2022\/09\/26\/cbo-student-loan-forgiveness-biden\/\" target=\"_blank\" rel=\"noopener\">cost<\/a>\u00a0around $400 billion.\u00a0The Biden administration has claimed that it will <a href=\"https:\/\/www.ed.gov\/news\/press-releases\/us-department-education-estimate-biden-harris-student-debt-relief-cost-average-30-billion-annually-over-next-decade\" target=\"_blank\" rel=\"noopener\">cost<\/a> around $300 billion.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Biden administration\u2019s student loan forgiveness plan was pushed back again on Wednesday after an appeals court refused to pause a previous ruling against the policy.
