Democrats like Elizabeth Warren have promised to create new \u201c<a href=\"https:\/\/jonathanturley.org\/2022\/04\/28\/there-are-going-to-be-rules-warren-pledges-wealth-tax-and-social-media-regulations-after-musk-purchase-of-twitter\/\" target=\"_blank\" rel=\"noreferrer noopener\">rules<\/a>\u201d governing discourse on the private platform (remember when <a href=\"https:\/\/twitter.com\/toure\/status\/1386183696114405377\" target=\"_blank\" rel=\"noreferrer noopener\">leftists<\/a> were pretending they believed in free-association rights?). Hillary Clinton\u2019s approach has been more sweeping, calling for the European Union to <a href=\"https:\/\/twitter.com\/HillaryClinton\/status\/1517247388716613634?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noreferrer noopener\">create<\/a> a technocratic speech regime to govern American companies to \u201cbolster global democracy before it\u2019s too late.\u201d<\/p>\n<p>And Europe has answered the call. Thierry Breton, the EU\u2019s commissar of \u201cinternal market,\u201d <a href=\"https:\/\/www.wsj.com\/articles\/eu-official-warns-elon-musk-changes-needed-at-twitter-11669833755\" target=\"_blank\" rel=\"noreferrer noopener\">says<\/a> that \u201cTwitter will have to implement transparent user policies, significantly reinforce content moderation and protect freedom of speech, tackle disinformation with resolve, and limit targeted advertising.\u201d Reuters <a href=\"https:\/\/www.reuters.com\/technology\/eu-warns-musk-that-twitter-faces-ban-over-content-moderation-ft-2022-11-30\/\" target=\"_blank\" rel=\"noreferrer noopener\">notes<\/a>, \u201cBreton told Musk he must adhere to a checklist of rules, including ditching an \u2018arbitrary\u2019 approach to reinstating banned users and agreeing to an \u2018extensive independent audit\u2019 of the platform by next year.\u201d<\/p>\n<p>Must he?<\/p>\n<p>For one thing, the EU\u2019s demands are in direct conflict with each other. The state can\u2019t protect \u201cfreedom of speech\u201d and compel private institutions to \u201ctackle disinformation\u201d and \u201creinforce content moderation.\u201d Speech is not free if it needs the state\u2019s imprimatur. And American companies should not function under the authoritarian diktats of the Chicoms or the EU nomenklatura.<\/p>\n<p>It\u2019s helpful to remember that the EU does not share Musk\u2019s liberal conception of \u201cfree speech\u201d as an inalienable right, but rather, it views open discourse as a government-provided privilege. Article 10 of the European Convention on Human Rights <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1998\/42\/schedule\/1\" target=\"_blank\" rel=\"noreferrer noopener\">begins<\/a> by promising \u201cthe right to freedom of expression,\u201d but soon warns that speech is contingent on the vagaries, conditions, and restrictions of \u201cnational security,\u201d \u201cterritorial integrity,\u201d the \u201cprevention of disorder or crime,\u201d and \u201chealth or morals.\u201d Or, in other words, the state can arbitrarily impose limits at will \u2014 which sounds a lot like the contemporary American left\u2019s emerging position on free speech.<\/p>\n<p>Nearly every censor in the history of mankind has argued that speech should be curbed to fight existential threats to society. And nearly every censor in history, sooner or later, expands the threat to undercut the rights of their political opponents. As anyone who\u2019s been paying attention for the past few years knows, the concept of \u201cdis-\u201d or \u201cmis-\u201d information has been abused for partisan purposes \u2014 whether the state colludes with Facebook to <a href=\"https:\/\/www.foxnews.com\/politics\/state-ags-fauci-zuckerberg-colluded-kill-covid-lab-leak-theory\" target=\"_blank\" rel=\"noreferrer noopener\">ban<\/a> discussion of the origins of Covid to appease China or <a href=\"https:\/\/thefederalist.com\/2022\/08\/26\/confirmed-fbi-colluded-with-big-tech-to-prevent-voters-from-learning-about-hunter-bidens-laptop\/\" target=\"_blank\" rel=\"noreferrer noopener\">pressures<\/a> tech companies to suppress legitimate news during election season to bolster their preferred candidates. This goes on <a href=\"https:\/\/www.forbes.com\/sites\/jeanbaptiste\/2018\/01\/09\/france-could-ban-facebook-twitter-in-fight-against-fake-news-during-elections\/?sh=519481e049da\" target=\"_blank\" rel=\"noreferrer noopener\">openly<\/a> in Europe.<\/p>\n<p>Germany has also pressured the European Union to pass internet regulations that would purportedly combat \u201cracism and xenophobia,\u201d which every EU member nation has since incorporated into its national legislation. In Germany, citizens can face fines for saying something puerile or hateful, or <a href=\"https:\/\/www.washingtonpost.com\/world\/2021\/09\/09\/pimmelgate-german-politician-police-raid\/\" target=\"_blank\" rel=\"noreferrer noopener\">insulting<\/a> politicians.
