If the children do use the restroom, it causes them \u201canxiety and emotional distress,\u201d and they fear they will be exposed to the opposite sex, the suit says. One of the children, a ninth grade girl, takes a friend with her to make sure no boy \u201cviolates her modesty.\u201d<\/p>\n<p>The Bethel school district sits just north of Dayton and <a href=\"https:\/\/nces.ed.gov\/ccd\/districtsearch\/district_detail.asp?Search=2&#038;ID2=3904861&#038;DistrictID=3904861&#038;details=1\" target=\"_blank\" rel=\"noopener\">serves<\/a> nearly 1,600 K-12 students.<\/p>\n<p>The bathroom policy \u201cblindsided\u201d parents after it was implemented secretly, violating Ohio\u2019s Open Meetings Act, the parents claim.<\/p>\n<p>A district faculty member proposed the new bathroom policy at a school board meeting in September of last year, and the change was adopted in January with\u00a0no public discussion, according to the lawsuit.<\/p>\n<p>\u201cThe Board\u2019s actions keep the community in the dark regarding its new rules and policies for intimate facilities by refusing to answer basic questions parents need to know to make decisions about their child\u2019s education,\u201d reads the lawsuit.\u00a0\u201cThe parental right to direct the education, safety, and upbringing of their children is the oldest fundamental right recognized by the Supreme Court. And the Board\u2019s actions deny these parents the same.\u201d<\/p>\n<p>Previously, transgender students could use a private single-stall bathroom, but the faculty member who proposed the new policy argued it was unfair to make a transgender student do this simply \u201cbecause they were born a man,\u201d according to the complaint.<\/p>\n<p>Two Muslim parents even donated out of their own pocket to build a sex-neutral restroom next to the main bathrooms at one school, the lawsuit says, and the district built the bathroom, but introduced the transgender policy anyway.<\/p>\n<p>The school board <a href=\"https:\/\/www.foxnews.com\/media\/muslim-christian-parents-sue-ohio-school-board-transgender-bathroom-locker-room-policies.amp\" target=\"_blank\" rel=\"noopener\">argued<\/a> it had \u201cno choice,\u201d saying the change was necessary to comply with Title IX since \u201cthe federal government was threatening school funding, and potential litigation was imminent.\u201d The lawsuit calls that claim \u201cincorrect\u201d because Title IX\u2019s language and regulations\u00a0\u201cexpressly provide for Bethel\u2019s historic practice of separating intimate facilities based on biological sex.\u201d<\/p>\n<p>The parents also complained that students as young as fifth grade are required to do assignments that promote LGBTQ views, including reading a story about \u201ca queen who wanted to be a king and her noble struggle to be accepted as a boy.\u201d Students are also asked to complete surveys about their attitudes on sexual and transgender issues without parental notice, the parents said.<\/p>\n<p>America First Legal (AFL), the conservative legal group representing the parents, emphasized that it will continue to fight for parents\u2019 right to protect their children\u2019s personal privacy.<\/p>\n<p>\u201cSchool districts across the country \u2014 the leadership of which have been captured by woke ideologues and weak-spined bureaucrats \u2014 are actively destroying fundamental rights,\u201d AFL Vice President Gene Hamilton <a href=\"https:\/\/aflegal.org\/afl-sues-bethel-school-board-in-ohio-for-forcing-children-to-share-bathrooms-and-locker-rooms-with-members-of-the-opposite-sex-and-for-violating-parents-rights\/\" target=\"_blank\" rel=\"noopener\">said<\/a> in a statement.<\/p>\n<p>\u201cGenerations of Americans have grown up in environments that have unquestionably respected students\u2019 personal privacy in intimate spaces, separated by biological sex,\u201d he said. \u201cYet here we are as a society in the year 2022 subjecting students across this country to the kinds of anti-science, social experiments that would have once been unfathomable and absurd a decade ago.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ohio parents are suing their local school board over a new transgender policy that allows students to use the bathroom and locker room that correspond with their gender identity.
