Texas<\/em> where states are seeking to have Biden\u2019s so-called <a href=\"https:\/\/www.breitbart.com\/immigration\/2021\/02\/21\/joe-bidens-dhs-protects-most-illegal-aliens-sanctuary-country-orders\/\">\u201csanctuary country\u201d<\/a> orders thrown out. The orders ensure that most of the nation\u2019s 11 to 22 million illegal aliens are not eligible for arrest or deportation.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>In a number of instances, Justices Sotomayor, Kagan, and Jackson \u2014 considered the Court\u2019s liberal faction \u2014 either used the term \u201calien\u201d directly to describe illegal aliens in the U.S. or referenced the term while quoting prior cases and federal immigration statute. Sotomayor said:<\/p>\n<blockquote>\n<p>What the government has said, and what the record clearly proves, is that there\u2019s been a surge at the border. If left unattended, that surge would overwhelm all of the border states, not just Texas, and that the cost of doing that has to give them greater priorities in terms of aliens who are already here.<\/p>\n<\/blockquote>\n<p>\u201cIt says that you, does not create \u2018any\u2019 \u2014 and any is very broad \u2014 \u2018right or benefit that is legally enforceable by any party.\u2019 It doesn\u2019t say any alien party, it doesn\u2019t say anything like that,\u201d Sotomayor said in another instance.<\/p>\n<p class=\"a8d-pre\">\u201c\u2026 that\u2019s not the language, isn\u2019t limited to that situation,\u201d Sotomayor continued. \u201cIt doesn\u2019t say any right or benefit that is legally enforceable by an undocumented alien. It says \u2018any party.&#8217;\u201d<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cYou are basically trying to sneak into \u2026 and say you must remove these people whether or not you want to or not \u2026 so once you say that, then how can the guidelines be wrong because it\u2019s simply a statement that says these aliens, we\u2019re not going to remove,\u201d Sotomayor said, using the term for the fourth time.<\/p>\n<p>Later, Kagan and Jackson each referenced the term \u201calien\u201d to describe illegal aliens while quoting prior cases and federal immigration statutes.<\/p>\n<p>\u201cIf you look at the language of 1231, \u2018It\u2019s the Attorney General shall detain the alien,\u2019 it doesn\u2019t say anything about shall remove, it doesn\u2019t say anything about shall apprehend, shall arrest, it just says \u2018shall detain,&#8217;\u201d Kagan said.<\/p>\n<p>\u201cThe statute\u2019s text in A says \u2018Pending a removal decision on whether the alien is to be removed from the United States,&#8217;\u201d Jackson said.<\/p>\n<p class=\"a8d-pre\">The justices using the term \u201calien\u201d to describe illegal aliens in the U.S. comes as Biden\u2019s Department of Homeland Security (DHS) has sought to purge the term from all federal agencies.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>In April 2021, for instance, Biden\u2019s Immigration and Customs Enforcement (ICE) agents and Customs and Border Protection (CBP) agents <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/04\/19\/biden-orders-ice-agents-to-stop-using-terms-illegal-alien-assimilation\/\">were ordered<\/a> to stop using the terms \u201cillegal alien\u201d and \u201cassimilation\u201d and replace them with \u201cnoncitizen\u201d and \u201cintegration.\u201d The U.S. Citizenship and Immigration Services (USCIS) also removed the term \u201calien\u201d from its site to be \u201cmore inclusive.\u201d<\/p>\n<p>Then, in July 2021, the Biden administration <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/07\/27\/biden-official-orders-immigration-judges-to-stop-using-illegal-alien-term\/\">ordered<\/a> federal immigration judges not to use the terms \u201calien\u201d and \u201cillegal alien.\u201d Instead, judges are to use \u201cnoncitizen\u201d and \u201cundocumented individual.\u201d<\/p>\n<p>In December 2021, USCIS continued <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/12\/15\/report-biden-agencies-purge-term-alien-favor-noncitizen\/\">purging<\/a> the terms \u201calien\u201d and \u201cillegal alien\u201d from its website and lengthy agency manual.<\/p>\n<p>The term \u201calien\u201d is regularly used as a legal definition to describe a foreign national in the U.S. The Immigration and Nationality Act (INA) codified the term in law and\u00a0<a class=\"x5l\" href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:8%20section:1101%20edition:prelim)\" target=\"_blank\" rel=\"noopener external\">defines\u00a0<\/a>it\u00a0as \u201cany person not a citizen or national of the United States.\u201d<\/p>\n<p class=\"a8d-pre\">The case is\u00a0<em>United States v.
