The food item\u2019s packaging claims that the macaroni and cheese will be ready in three-and-a-half minutes, but Ramirez alleged that it takes more time to make the product when other steps are taken into consideration.\u00a0<\/p>\n<p class=\"p1\">\u201cThe statement of \u2018ready in 3\u00bd minutes\u2019 is false and misleading because the Product takes longer than 3-and-a-half minutes to prepare for consumption,\u201d the lawsuit <a href=\"https:\/\/www.classaction.org\/media\/ramirez-v-kraft-heinz-food-company.pdf\" target=\"_blank\" rel=\"noopener\">stated<\/a>. It went on to describe the process of making the food and the directions involved.\u00a0<\/p>\n<p class=\"p1\">\u201cConsumers seeing \u2018ready in 3\u00bd minutes\u2019 will believe it represents the total amount of time it takes to prepare the Product, meaning from the moment it is unopened to the moment it is ready for consumption,\u201d it stated.\u00a0<\/p>\n<p class=\"p1\">The lawsuit also <a href=\"https:\/\/www.npr.org\/2022\/11\/28\/1139415169\/velveeta-mac-and-cheese-lawsuit-prep-time\" target=\"_blank\" rel=\"noopener\">alleged<\/a> that the macaroni product is able to be marketed at a higher cost because of its claims about how soon the food can be ready to eat.\u00a0<\/p>\n<p class=\"p1\">In a <a href=\"https:\/\/www.washingtonpost.com\/food\/2022\/11\/27\/velveeta-mac-and-cheese-lawsuit\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> to The Washington Post, the Kraft Heinz Co. said that they knew about the \u201cfrivolous lawsuit\u201d and \u201cwill strongly defend against the allegations in the complaint.\u201d<\/p>\n<p class=\"p1\">William Wright of the Wright Law Office in West Palm Beach, and Spencer Sheehan of Sheehan &#038; Associates in Great Neck, New York, reportedly filed the <a href=\"https:\/\/www.sun-sentinel.com\/business\/fl-bz-mac-and-cheese-prep-time-suit-20221126-y5p7fxq5ibdvvpmgqwukx3di2e-story.html\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> this month.\u00a0<\/p>\n<p class=\"p1\">\u201cI\u2019ve gotten a lot of flak about this case, but deceptive advertising is deceptive advertising,\u201d Wright told the Post on Monday over email. \u201cHere, Kraft charges extra for a desirable feature (saving time) but the marketing is false, it takes far longer for the product to be ready than as advertised. Deceptive advertising plain and simple.\u201d\u00a0<\/p>\n<p class=\"p1\">\u201cThere are a lot of people that may feel this is just a little fibbing and not really a case and I get that. But we are striving for something better,\u201d Wright said in the email. \u201cWe want corporate America to be straightforward and truthful in advertising their products. My firm also represents clients in what most would say are more compelling cases (arsenic in baby food, etc.) but we don\u2019t feel corporations should get a pass for any deceptive advertising. The consumers deserve better.\u201d<\/p>\n<p class=\"p1\">The lawsuit taps into the efforts of many Americans to make their money go further in the current economic environment of sky-high <a href=\"https:\/\/www.dailywire.com\/topic\/inflation\" target=\"_blank\" rel=\"noopener\">inflation<\/a>.
