And by doing so, <a href=\"https:\/\/www.theepochtimes.com\/t-colorado\">Colorado<\/a> voters also voted to penalize <a href=\"https:\/\/www.theepochtimes.com\/t-marriage\">marriage<\/a>.<\/p>\n<p>According to the nation\u2019s leading independent tax policy nonprofit,\u00a0<a href=\"https:\/\/taxfoundation.org\/colorado-proposition-121\/\">Tax Foundation<\/a>, when Colorado passed Proposition FF or the\u00a0<a href=\"https:\/\/leg.colorado.gov\/sites\/default\/files\/images\/blue_book_2022_english_for_web.pdf\">Healthy School Meals for All<\/a>\u00a0ballot measure, it created a \u201ctax cliff\u201d that penalizes married high earners. It is\u00a0the first time Colorado has adopted such a penalty.<\/p>\n<h2>Colorado Adopts Marriage Penalty<\/h2>\n<p>Beginning in 2023, Proposition FF limits state income tax deductions to $12,000 for single filers or $16,000 for joint filers and applies to standard or itemized deductions. That limit applies to any household making more than $300,000 per year without a higher tax bracket for marriage.<\/p>\n<p>As such, if an individual makes $299,999, they\u2019ll be able to claim total itemized deductions. But, if two individuals making $150,000 each marry, their deductions will be limited under Colorado\u2019s new law. (Jim Watson\/AFP\/Getty Images)<\/figure>\n<p>According to the Tax Foundation, state measures such as Proposition FF are known as \u201cmarriage penalties\u201d because they impose a higher effective tax rate on married couples who file jointly than on two single individuals with the same amount of combined income.<\/p>\n<p>Additionally, marriage penalty taxes are considered a \u201cnon-neutral tax treatment\u201d that\u2019s peculiarly harmful to smaller businesses such as sole proprietorships, S corporations, and partnerships, as these businesses typically report income on the individual tax returns of the owners.<\/p>\n<p>Before Proposition FF\u2019s passage, 16 states had marriage <a href=\"https:\/\/taxfoundation.org\/state-marriage-penalty-2022\/\">penalties<\/a>: California, Georgia, Maryland, Minnesota, New Jersey, New Mexico, New York, North Dakota, Ohio, Oklahoma, Rhode Island, South Carolina, Vermont, Virginia, Washington, and Wisconsin.<\/p>\n<p>With Proposition FF\u2019s passage, Colorado joins the above 16 states.<\/p>\n<p>Arkansas, Delaware, Iowa, Mississippi, Missouri, Montana, and West Virginia, as well as the District of Columbia, also have a marriage tax penalty. However, the passage of then-President Trump\u2019s tax reform plan, the 2017 Tax Cuts and Jobs Act (TCJA), which took effect in 2018, lessened the tax impact.<\/p>\n<p>The passage of the TCJA was considered the largest overhaul of the tax code in three decades, and many of the benefits were set up to help families. Most of those benefits for families will expire in 2025.<\/p>\n<h2>Proposition FF<\/h2>\n<p>In the past, Colorado voters have shown little desire to boost taxes. In 1992, they went so far as to establish the Taxpayers\u2019 Bill of Rights, or TABOR, which limits the revenue governments can retain and spend and requires voter approval for tax increases. Accordingly, since TABOR\u2019s implementation, 25 statewide\u00a0<a href=\"https:\/\/ballotpedia.org\/Colorado_Proposition_FF,_Reduce_Income_Tax_Deduction_Amounts_to_Fund_School_Meals_Program_Measure_(2022)\">ballot measures<\/a>\u00a0impacting taxes have been put forward for voter approval. (Karen Ducey\/Getty Images)<\/figure>\n<p>Opponents of the proposition argued that the measure saps money from the economy and families investing their money as they see fit. They also said that \u201cthe state should not pay to feed kids who can afford to purchase a school meal or bring food from home.\u201d<\/p>\n<p>Proponents of Proposition FF argued that kids experiencing hunger have \u201clower grades than their peers and are more likely to struggle with behavioral problems and experience emotional, mental, and physical health issues.\u201d<\/p>\n<p>That argument seemed to resonate with Colorado voters, who voted to pass Proposition FF, adding it to the list of taxpayer-funded social programs.<\/p>\n<p>In November 2020, Colorado voters approved a proposition, effective Jan. 1, 2023, requiring employers and employees to contribute 0.9 percent of the employee\u2019s wage to a state-run insurance program. If an employee makes $104,000 annually, the employer and employee will pay $468 toward the insurance program for a combined total payment of $936 annually.<\/p>\n<p>As a result, starting in 2024, if a Colorado employee has a medical event, they can take up to 12 weeks of paid family and medical leave and receive up to $1,100 per week in wages, depending on their salary.
