However, the anti-mandate group Let Them Choose posed a legal challenge to the district in October 2021.<\/p>\n<p>The court called the district\u2019s so-called roadmap a strained argument that does not actually mandate students to be vaccinated against COVID but \u201crather gives them a choice to either do so or be enrolled in independent study,\u201d adding the choice resembles \u201cthe school cafeteria offering a choice between Brussels sprouts or broccoli.\u201d<\/p>\n<p>\u201cWe doubt that students and their parents perceive a real choice,\u201d the court filing reads. \u201cFor some, independent study would likely be a step backwards.\u201d<\/p>\n<p>The ruling cited reports from California\u00a0Department of Education officials who argue that independent study programs work for some students who typically have support from their parents or guardian, motivation, and a strong commitment to work independently.<\/p>\n<p>Lee Andelin, attorney for plaintiff Let Them Choose, told the <a href=\"https:\/\/www.latimes.com\/california\/story\/2022-11-23\/san-diego-unified-covid-vaccine-mandate-appeals-court\">Los Angeles Times<\/a> the court\u2019s ruling makes a \u201cgreat win for children and the rule of law and ensures consistency statewide.\u201d<\/p>\n<p>\u201cThe published opinion applies to all California school districts and sets important precedent to protect access to education,\u201d Andelin said.<\/p>\n<p>Dean White, a Washington-based lawyer who has been a part of several cases surrounding COVID mandates, to the <a href=\"https:\/\/californiaglobe.com\/articles\/california-appellate-court-panel-strikes-down-sdusd-appeal-of-vaccine-mandate-ban\/\">California Globe<\/a> that the district could have avoided the issue if only it allowed religious and personal belief exemptions.<\/p>\n<p>\u201cA lot of parents still would have not liked the mandate itself, but it would have given many a reasonable way out,\u201d White said. \u201cInstead, the district backed them into a corner and didn\u2019t even hear them out on it before putting in that mandate.\u201d<\/p>\n<p>White argued although children\u2019s health and safety are essential, religious beliefs are also important, citing students have the right to individually pray or wear religious symbols such as the cross, the star of David, or a hijab.<\/p>\n<p>\u201cBut here, even if it went against your beliefs, they said you had to take a vaccine and go against your faith, or go to alternate methods,\u201d White added. \u201cYou can see why judges keep siding on these groups challenging school districts over this \u2014 and the San Diego case is huge and precedent-making.\u201d<\/p>\n<p>Mike Murad, San Diego Unified spokesperson, told the L.A.
