The order went into effect immediately, pending an appeal from state officials. The superior court of Fulton County previously overturned the law last week; it had previously been blocked by a federal court until the Supreme Court overturned\u00a0<em>Roe v. Wade\u00a0<\/em>this past summer.<\/p>\n<p>\u201cThe State of Georgia\u2019s Emergency Petition for Supersedeas seeking a stay of the order of the Superior Court of Fulton County\u00a0in [STATE OF GEORGIA v. SISTERSONG WOMEN OF COLOR REPRODUCTIVE JUSTICE COLLECTIVE et al.] is hereby granted,\u201d the court wrote in a <a href=\"https:\/\/www.gasupreme.us\/wp-content\/uploads\/2022\/11\/s23m0358.pdf\" target=\"_blank\" rel=\"noopener\">one-page order<\/a>. The decision of the court was unanimous; presiding justice Nels S.D. Peterson was disqualified, and justice Andrew A. Pinson did not participate. The court also dismissed a separate request for an administrative stay.<\/p>\n<p>According to the <a href=\"https:\/\/www.ajc.com\/politics\/state-asks-georgia-supreme-court-to-allow-enforcement-of-abortion-law\/TZYXSAXNPZFKJMLQ5AOUOE4BSI\/\" target=\"_blank\" rel=\"noopener\">Atlanta Journal-Constitution<\/a>, lawyers for the state appealed to the Supreme Court days after the Fulton County court ruling. \u201cThe harm to the state is significant and irreparable,\u201d attorneys wrote in their appeal, via the AJC. \u201cUnborn children are at risk every day that the injunction continues.\u201d<\/p>\n<p>The lower court ruling had overturned the law on the basis that it was unconstitutional when it was passed in 2019; in their appeal, state attorneys said that did not matter since the law is constitutional now because of the Supreme Court\u2019s decision in\u00a0<em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>, which overturned\u00a0<em>Roe v. Wade\u00a0<\/em>and sent abortion back to the states. \u201cThe Superior Court fundamentally misunderstood the role of courts, which merely interpret law in the course of issuing judgments in individual cases,\u201d attorneys wrote. \u201cCourts do not amend the constitution, and the constitution does not change simply because a court\u2019s view of it changes.\u201d<\/p>\n<p>In the meantime, abortion clinics in Georgia had <a href=\"https:\/\/www.ajc.com\/politics\/georgia-supreme-court-orders-states-abortion-law-back-into-effect\/D5VPGTJNLVGMPDHOGORBCYIKSI\/\" target=\"_blank\" rel=\"noopener\">resumed providing abortion services<\/a> for women at up to 22 weeks of pregnancy, which was the standard practice before the law was passed. The Feminist Women\u2019s Health Center, an abortion clinic in Atlanta, told the AJC they had no abortions scheduled for Wednesday, but several were scheduled for Saturday in which a fetal heartbeat could be detected.<\/p>\n<p>Last week, <a href=\"https:\/\/www.documentcloud.org\/documents\/23307352-ga-abortion-ruling-111522\" target=\"_blank\" rel=\"noopener\">Fulton County Superior Court<\/a> judge Robert McBurney overturned the \u201cLiving Infants Fairness and Equality (LIFE) Act,\u201d which bans abortion after six weeks of pregnancy. McBurney declared the law void under Georgia law, citing a provision that declares unconstitutional laws void from the time of their passage, and mandates that the judiciary declares them so.<\/p>\n<p>In 2019, \u201ceverywhere in America, including Georgia, it was unequivocally unconstitutional for governments \u2014 federal, state, or local \u2014 to ban abortions before viability,\u201d McBurney wrote. Therefore, the LIFE Act \u201cdid not become the law of Georgia when it was enacted and it is not the law of Georgia now,\u201d he concluded.<\/p>\n<p>\u201cWhat does this ruling mean? Most fundamentally, it means that courts \u2014 not legislatures \u2014 define the law,\u201d McBurney concluded. \u201cIf the courts have spoken, clearly and directly, as to what the law is, as to what is and is not constitutional, legislatures and legislators are not at liberty to pass laws contrary to such pronouncements.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Georgia Supreme Court has reinstated the state\u2019s six week abortion ban.
