Cannon previously approved Trump\u2019s request for a special master to oversee the FBI\u2019s audit of a trove of documents confiscated from Trump in an August FBI raid.<\/p>\n<p>In a Tuesday court <a href=\"https:\/\/www.scribd.com\/document\/609516253\/Trump-Affidavit-Motion#fullscreen&#038;from_embed\" target=\"_blank\" rel=\"noopener\">filing<\/a>, Trump\u2019s attorneys argued that they need access to the underlying affidavit to ensure the information the FBI used to justify the raid was accurate and to ensure that their client\u2019s rights are being respected. The publicly-released version of the affidavit <a href=\"https:\/\/www.dailywire.com\/news\/breaking-doj-releases-affidavit-justifying-fbi-raid-on-trump\" target=\"_blank\" rel=\"noopener\">contained<\/a> significant redactions.<\/p>\n<p>\u201cIn the public version, \u2026 50 of the affidavit\u2019s 84 total paragraphs are blacked out; of the 55 paragraphs following the header \u2018Probable Cause,\u2019 only four are fully unredacted,\u201d the filing says. \u201cThere is no legitimate basis to withhold the redacted information from Plaintiff.\u201d<\/p>\n<p>The DOJ has said that the redactions to the affidavit are necessary to protect sources that have aided in the FBI investigation into the Mar-a-Lago documents. The DOJ\u2019s sources\u2019 identities must continue to be protected in case the department should need them later in its investigation, the government has said. The redactions also protect important FBI methods of investigation, according to <a href=\"https:\/\/abcnews.go.com\/Politics\/trump-lawyers-doj-ordered-turn-unredacted-mar-lago\/story?id=93807888\" target=\"_blank\" rel=\"noopener\">ABC News<\/a>.<\/p>\n<p>Trump\u2019s attorneys said that repeated leaks about the investigation from the DOJ to the media have undermined the government\u2019s case to keep its own sensitive information protected.<\/p>\n<p>\u201cThe exceptional circumstances here \u2014 including a virtually limitless search of a President\u2019s home, the seizure of huge amounts of personal materials including attorney-client privileged documents, and an Attorney General\u2019s publication of the Government\u2019s position in an unprecedented press conference \u2014 require the disclosure of the affidavit,\u201d the filing says.<\/p>\n<p>\u201cThe idea that the Government must keep the details of the affidavit from Plaintiff is further undermined by the repeated leaks by DOJ of selected and misleading information,\u201d it continued. \u201cThe Government\u2019s conduct alone justifies the release of the affidavit to Plaintiff.\u201d<\/p>\n<p>The filing in Cannon\u2019s court came hours before the former president\u2019s legal team faced off with prosecutors in front of a three-judge panel at the 11th Circuit Court of Appeals in Atlanta. The judges heard arguments over the basis of Cannon\u2019s decision to approve Trump\u2019s request for a special master.<\/p>\n<p>The judges on the panel, two of whom were Trump appointees, appeared skeptical of the Trump team\u2019s arguments, according to <a href=\"https:\/\/www.politico.com\/news\/2022\/11\/22\/feds-battle-trump-over-outside-review-of-seized-mar-a-lago-documents-00070541?nname=playbook&#038;nid=0000014f-1646-d88f-a1cf-5f46b7bd0000&#038;nrid=0000015e-f320-d26d-a7fe-fbf341270000&#038;nlid=630318\" target=\"_blank\" rel=\"noopener\">Politico<\/a>. The judges pushed Trump\u2019s attorneys for a basis for a special master in a case where the affidavit has not been found to be incorrect. Trump\u2019s team argued about the unprecedented nature of the case in which the home of a former president was raided by the FBI.<\/p>\n<p>Attorney General Merrick Garland <a href=\"https:\/\/www.dailywire.com\/news\/from-the-hague-to-obamas-irs-scandal-meet-jack-smith-the-new-special-counsel-to-investigate-trump\" target=\"_blank\" rel=\"noopener\">named<\/a> a special counsel last week to take over the DOJ investigation into the documents.
