Judge Mark Pittman of the U.S. District Court for the Northern District of Texas made mincemeat of Biden\u2019s decision to discharge billions in debt without congressional authorization: \u201cIn this country,\u201d he <a href=\"https:\/\/ordinary-times.com\/wp-content\/uploads\/2022\/11\/gov.uscourts.txnd_.368635.37.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">admonished<\/a>, \u201cwe are not ruled by an all-powerful executive with a pen and a phone.\u201d Taxpayers can thank the \u201cmajor questions doctrine\u201d for saving them from potentially billions in future tax increases.<\/p>\n<p><a href=\"https:\/\/www.klgates.com\/Supreme-Court-Advances-Major-Questions-Doctrine-and-Limits-EPAs-Authority-to-Regulate-Power-Plant-Carbon-Emissions-7-6-2022\" target=\"_blank\" rel=\"noreferrer noopener\">Invoked last term<\/a> to kill an attempt by the Environmental Protection Agency to regulate greenhouse gas emissions, the major questions doctrine looms large in today\u2019s age of expansive regulation. By requiring elected representatives in Congress rather than unelected bureaucrats to tackle major policy issues, this judicial doctrine polices the boundaries of our constitutional separation of powers and bolsters democratic accountability. In practice, as Justice Neil Gorsuch <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/20-1530#writing-20-1530_CONCUR_5\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a>, this means that when it comes to \u201cdecisions of vast economic and political significance\u201d \u2014 that is, major questions \u2014 \u201cadministrative agencies must be able to point to clear congressional authorization.\u201d<\/p>\n<p>This is nothing new. Nearly 200 years ago, Chief Justice John Marshall <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/23\/1\/\" target=\"_blank\" rel=\"noreferrer noopener\">differentiated<\/a> \u201cimportant subjects which must be \u2026 regulated\u201d directly by Congress from matters of \u201cless interest\u201d that Congress can delegate to the Executive Branch. This dynamic follows simply from the constitutional text: Article I <a href=\"https:\/\/www.archives.gov\/founding-docs\/constitution-transcript\" target=\"_blank\" rel=\"noreferrer noopener\">vests<\/a> \u201clegislative Powers \u2026 in a Congress of the United States.\u201d Article II, in turn, <a href=\"https:\/\/www.archives.gov\/founding-docs\/constitution-transcript\" target=\"_blank\" rel=\"noreferrer noopener\">vests<\/a> the \u201cexecutive Power \u2026 in a President of the United States of America,\u201d under whom and pursuant to whose authority today\u2019s administrative agencies function. In other words, so long as Congress makes the principal policy judgment, power remains in the hands of the people, and our constitutional separation of powers remains intact. The president\u2019s debt forgiveness program grievously runs afoul of these core constitutional tenets.<\/p>\n<p>At the stroke of a pen, and knowing full well he lacked the votes in Congress to do so lawfully, Biden <a href=\"https:\/\/www.wsj.com\/articles\/biden-to-announce-student-loan-forgiveness-plan-11661331600\" target=\"_blank\" rel=\"noreferrer noopener\">moved to eliminate<\/a> billions in student debt. As his source of authority, the president invoked the <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1412\" target=\"_blank\" rel=\"noreferrer noopener\">HEROES Act<\/a>, an early 2000s-era statute <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1412\/text\" target=\"_blank\" rel=\"noreferrer noopener\">empowering<\/a> the secretary of education to \u201cwaive\u201d debt obligations he \u201cdeems necessary in connection with a \u2026 national emergency.\u201d On its face, the act may seem to authorize mass loan forgiveness amid emergencies such as pandemics. Read in context, however, the secretary\u2019s authority is likely more modest than the president would have us believe.\u00a0<\/p>\n<p>As <a href=\"https:\/\/ordinary-times.com\/wp-content\/uploads\/2022\/11\/gov.uscourts.txnd_.368635.37.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">highlighted<\/a> by Judge Pittman, the Congress enacting the HEROES Act contemplated relief for \u201caffected individuals,\u201d defined as those employed \u201cin an area that is declared a disaster\u201d or has otherwise \u201csuffered direct economic hardship as a direct result of a war or other military operation or national emergency.\u201d Congress provided, moreover, that the relief be \u201cnecessary in connection\u201d with said emergency.
