Loan payments were placed on hold in early 2020 under the Trump administration, and the moratorium has been extended multiple times.<\/p>\n<p>In a <a href=\"https:\/\/www.ed.gov\/news\/press-releases\/biden-harris-administration-continues-fight-student-debt-relief-millions-borrowers-extends-student-loan-repayment-pause#:~:text=Loan%20Repayment%20Pause-,Biden%2DHarris%20Administration%20Continues%20Fight%20for%20Student%20Debt%20Relief%20for,Extends%20Student%20Loan%20Repayment%20Pause&#038;text=Today%2C%20the%20U.S.%20Department%20of,repayment%2C%20interest%2C%20and%20collections.\">news release issued<\/a> on Tuesday, the Department of Education announced it would extend the repayment pause and criticized Republican officials. The moratorium will be extended\u00a0until 60 days after the Biden administration is allowed to implement the plan and if the lawsuits are resolved.<\/p>\n<p>\u201cWe\u2019re extending the payment pause because it would be deeply unfair to ask borrowers to pay a debt that they wouldn\u2019t have to pay, were it not for the baseless lawsuits brought by Republican officials and special interests,\u201d Education Secretary Miguel Cardona said in a statement, claiming the lawsuits filed against the debt program are \u201ccallous efforts.\u201d<\/p>\n<p>Interest rates will remain at zero percent until repayments start under the plan. Under an earlier extension announced in April, people who were behind on payments before COVID-19 lockdowns and stay-at-home orders automatically would be put in good standing.<\/p>\n<p>Earlier this year, President <a href=\"https:\/\/www.theepochtimes.com\/t-joe-biden\">Joe Biden<\/a> announced a program that would forgive up to\u00a0$20,000 in federal student loans, although several courts have placed injunctions on the plan.\u00a0Previously, he said the payment pause will not be extended again, but that was before courts halted that program.<\/p>\n<p>Some 26 million people already have applied for debt relief, and 16 million were approved, officials have said. The debt forgiveness plan announced in August would cancel $10,000 in student loan debt for those making less than $125,000 or households with less than $250,000 in income. Pell Grant recipients, who typically demonstrate more financial need, would get an additional $10,000 in debt forgiven, for a total of $20,000.<\/p>\n<p>Multiple lawsuits filed by groups and states sought to block the program, and two of those challenges were successful. (Susan Walsh\/AFP via Getty Images)<\/figure>\n<h2>Program<\/h2>\n<p class=\"fnmMv geuMB alqtB wqIGQ\">In his news release, Cardona did not address arguments put forth in lawsuits against the program. Six Republican-led states wrote in a recent suit that the White House lacks the power to\u00a0forgive student loan debt due to the Constitution\u2019s separation of powers clause, and by forgiving the debt, it has superseded Congress\u2019s authority.<\/p>\n<p>The states also wrote that they would be financially injured if billions of dollars in student debt were canceled under the program, which was unveiled by Biden just weeks before the Nov. 8 midterm elections.\u00a0The St. Louis-based U.S. Court of Appeals for the 8th Circuit on Nov. 10 froze the plan, and a federal judge in Texas also struck it down, siding with a lawsuit brought by the Job Creators Network Foundation.<\/p>\n<p>The administration on Nov. 18 filed a lawsuit with the Supreme Court to reinstate its program, arguing that it has the authority to provide debt relief. After the program was announced,\u00a0Supreme Court associate Justice Amy Coney Barrett denied two emergency petitions to block it.<\/p>\n<p>\u201cThe Eighth Circuit\u2019s erroneous injunction leaves millions of economically vulnerable borrowers in limbo, uncertain about the size of their debt and unable to make financial decisions with an accurate understanding of their future repayment obligations,\u201d U.S. Solicitor General Elizabeth Prelogar, who represents the Biden administration, told the Supreme Court in an appeal (<a href=\"https:\/\/www.documentcloud.org\/documents\/23314019-student-debt-relief-appeal-to-supreme-court\">pdf<\/a>) on Friday.<\/p>\n<p>In temporarily halting the plan, U.S. District Judge Mark Pittman wrote in his order that it\u2019s not up to him to decide whether the program is \u201cgood public policy or not\u201d but stipulated that \u201cno one can plausibly deny that it is either one of the largest delegations of legislative power to the executive branch, or one of the largest exercises of legislative power without congressional authority in the history of the United States.\u201d<\/p>\n<p>Republicans said that the program is likely illegal and would give more power to the Biden administration, arguing that only Congress has the capacity to forgive debt. They\u2019ve also said that it was a brazen attempt to push younger voters to the polls to vote in favor of Democrat candidates during the 2022 midterm elections.<\/p>\n<p>In September, an NBC poll <a href=\"https:\/\/www.nbcnews.com\/meet-the-press\/meetthepressblog\/voters-split-student-loan-forgiveness-new-poll-shows-rcna48490\">found<\/a> that 44 percent of respondents viewed the debt relief program as a bad idea.
