Version: 4.0.47--><div><img decoding=\"async\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/02\/327B4654-BB14-4AFE-9B5F-226BDD96AB2E-scaled-e1600957951918.jpeg?w=1200&#038;h=800&#038;ixlib=react-9.0.3\" class=\"ff-og-image-inserted\" \/><\/div>\n<p>CNN legal analyst Joan Biskupic was excoriated for a Monday <a href=\"https:\/\/www.cnn.com\/2021\/02\/22\/politics\/clarence-thomas-trump-election-fraud\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">article<\/a> in which she claimed Justice Clarence Thomas sympathized with former President Donald Trump\u2019s allegations of election fraud in one of his dissents earlier this week.<\/p>\n<p>\u201cSupreme Court Justice Clarence Thomas on Monday claimed election fraud is a threat to America, revealing in a forceful dissent some support for former President Donald Trump and Republicans who have refused to accept the result of the 2020 election,\u201d Biskupic began in an article titled \u201cJustice Clarence Thomas reveals some sympathy for Trump\u2019s baseless fraud claims.\u201d<\/p>\n<p>In a tweet, Biskupic went even further to say Thomas \u201caligns\u201d with \u201cTrump\u2019s baseless election fraud claims.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Justice Clarence Thomas aligns with Trump on baseless election fraud claims: <a href=\"https:\/\/t.co\/hwjyWTJkOR\">https:\/\/t.co\/hwjyWTJkOR<\/a><\/p>\n<p>\u2014 Joan Biskupic (@JoanBiskupic) <a href=\"https:\/\/twitter.com\/JoanBiskupic\/status\/1363979104350072832?ref_src=twsrc%5Etfw\">February 22, 2021<\/a><\/p>\n<\/blockquote>\n<p>\u201cA longtime conservative, Thomas\u2019 legal views naturally aligned with the Trump administration,\u201d she continued in the article. \u201cBut his dissent stands out for how much it subscribed to the Trump worldview of fraud, a notion debunked by election law experts and that has failed overwhelmingly in dozens of state and federal court challenges.\u201d<\/p>\n<p>Before going after his wife, Ginni Thomas, for her views, Biskupic went on to pull various quotes from Thomas\u2019 11-page dissent, noting how often he used the word \u201cfraud\u201d and implying that Thomas and Trump are basically on the same page regarding the 2020 presidential election.<\/p>\n<p>Ed Whelan, who is a distinguished senior fellow of the Ethics and Public Policy Center,\u00a0<a href=\"https:\/\/www.nationalreview.com\/bench-memos\/bizarre-distortion-of-justice-thomass-election-dissent\/\" target=\"_blank\" rel=\"noopener noreferrer\">tore into Biskupic\u2019s article<\/a>\u00a0in a piece for National Review titled \u201cBizarre Distortion of Justice Thomas\u2019s Election Dissent.\u201d<\/p>\n<p>\u201cI\u2019m amazed to see that Thomas\u2019s dissent somehow generated this wildly distorted article from CNN\u2019s veteran Supreme Court reporter Joan Biskupic,\u201d he wrote.<\/p>\n<p>\u201cA trusting reader might imagine that Thomas\u2019s dissent is replete with references to Dominion and Smartmatic and to various of Trump\u2019s other allegations of fraud,\u201d Whelan continued. \u201cIn fact, Thomas makes no mention of such allegations. Nor does the word \u2018Trump\u2019 appear a single time in his opinion.\u201d<\/p>\n<p>\u201cMoreover, Thomas states in his opening paragraph (and repeats twice later) that the Pennsylvania supreme court decision that the Court was asked to review \u2018seems to have affected too few ballots to change the outcome of any federal election,\u2019\u201d added Whelan. \u201cThat\u2019s not a statement you ever heard Donald Trump make.\u201d<\/p>\n<p>Ilya Shapiro, director of the Robert A. Levy Center for Constitutional Studies at the Cato Institute, also took CNN to task for publishing Biskupic\u2019s article, calling it \u201cfalse framing.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">This is a false framing of Thomas\u2019s dissent. <a href=\"https:\/\/twitter.com\/CNN?ref_src=twsrc%5Etfw\">@CNN<\/a> you should retract. <a href=\"https:\/\/t.co\/d8AmZhVqlG\">https:\/\/t.co\/d8AmZhVqlG<\/a><\/p>\n<p>\u2014 Ilya Shapiro (@ishapiro) <a href=\"https:\/\/twitter.com\/ishapiro\/status\/1364696306006986755?ref_src=twsrc%5Etfw\">February 24, 2021<\/a><\/p>\n<\/blockquote>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Joan you should rewrite your piece. You know the case was about the independent state legislature doctrine and has nothing to do with Trumpian conspiracy theories.<\/p>\n<p>\u2014 Ilya Shapiro (@ishapiro) <a href=\"https:\/\/twitter.com\/ishapiro\/status\/1364696629400326145?ref_src=twsrc%5Etfw\">February 24, 2021<\/a><\/p>\n<\/blockquote>\n<p>Thomas was <a href=\"https:\/\/www.dailywire.com\/news\/citizens-deserve-better-justice-clarence-thomas-dissents-in-pa-election-case\">joined in his dissent<\/a> by Justices Samuel Alito and Neil Gorsuch. As The Daily Wire reported:<\/p>\n<blockquote>\n<p><em>Justice Clarence Thomas issued a vigorous dissent Monday in response to the Supreme Court\u2019s decision not to hear a challenge against the Pennsylvania state court\u2019s ruling that permitted ballots to be counted even if they were received three days after Election Day.<\/em><\/p>\n<p><em>\u201cOne wonders what the Court waits for,\u201d Thomas wrote. \u201cWe failed to settle this dispute before the election, and thus provide clear rules. Now we again fail to provide clear rules for future elections. The decision to leave election law hidden beneath a shroud of doubt is baffling. By doing nothing, we invite further confusion and erosion of voter confidence. Our fellow citizens deserve better and expect more of us.
