The former is a desperate follow-up to the latter after the House Select Committee on Jan. 6 emerged empty-handed from an 18-month investigation.<\/p>\n<p>\u201cIt is in the public interest to appoint a special prosecutor to independently manage an investigation and prosecution based on recent developments, including [Trump\u2019s] announcement that he is a candidate for president in the next election and the sitting president\u2019s stated intention to be a candidate as well,\u201d Garland told reporters at an afternoon <a href=\"https:\/\/www.youtube.com\/watch?v=ZjM3FXJBUUk\" target=\"_blank\" rel=\"noreferrer noopener\">press conference<\/a>. <\/p>\n<p>Trump officially <a href=\"https:\/\/thefederalist.com\/2022\/11\/16\/donald-trump-is-running-for-president-again-washington-would-be-wise-to-remember-2016\/\" target=\"_blank\" rel=\"noreferrer noopener\">declared<\/a> his candidacy to reclaim the Republican Party\u2019s presidential nomination this past Tuesday. Just as his administration was handicapped early on by a special counsel investigation probing left-wing conspiracies of Russian collusion, his third presidential campaign has already been hit with the same playbook. <\/p>\n<p>The timeline of Garland\u2019s announcement three days after Trump\u2019s announcement was surely a political calculation. As the <a href=\"https:\/\/thefederalist.com\/2022\/06\/10\/the-j6-inquisition-is-an-obvious-soviet-style-show-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">Soviet-style<\/a> Jan. 6 inquisition began to wind down on Capitol Hill with nothing to show this summer, Garland <a href=\"https:\/\/thefederalist.com\/2022\/08\/12\/breaking-fbi-raid-warrant-demanded-seizure-of-literally-any-record-trump-ever-saw-during-4-year-presidential-term\/\" target=\"_blank\" rel=\"noreferrer noopener\">personally signed off<\/a> on an unprecedented raid of a former president. Garland sent more than 30 plain clothes FBI agents to search Trump\u2019s Florida residence at Mar-a-Lago over apparent violations of the Presidential Records Act, a rarely prosecuted statute now being weaponized to prosecute political opponents. The entire investigation was set in motion by a disgruntled bureaucrat at the National Archives and Records Administration. The Justice Department alleged that Trump illegally took classified documents with him to Florida after he left the White House last year. <\/p>\n<p>All Americans want \u2014 and deserve \u2014 is an attorney general who cares about the law. Garland, however, is far from it. Look <a href=\"https:\/\/thefederalist.com\/2022\/08\/12\/merrick-garland-doesnt-care-about-the-rule-of-law-just-ask-hunter-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">no further<\/a> than his refusal to appoint a special prosecutor on Hunter Biden, whose father, serving as president, presents a legitimate conflict of interest worthy of an independent probe. Garland is a political activist with an <a href=\"https:\/\/thefederalist.com\/2022\/08\/09\/conflict-of-interest-much-garland-oversees-raid-on-president-who-denied-him-scotus-seat\/\" target=\"_blank\" rel=\"noreferrer noopener\">axe to grind<\/a> after his 2016 Supreme Court nomination was thwarted by the man he\u2019s now pledged to prosecute to the ends of the Earth.<\/p>\n<p>The appointment of a second special counsel to sic on Trump is the natural response of a Democrat to the ex-president\u2019s pursuit of a second term. The Russia hoax failed. The impeachment over a fabricated scandal in Ukraine <a href=\"https:\/\/thefederalist.com\/2020\/02\/05\/senate-majority-acquits-trump-on-all-impeachment-charges\/\" target=\"_blank\" rel=\"noreferrer noopener\">failed<\/a>. Prosecution over the Emoluments Clause <a href=\"https:\/\/thefederalist.com\/2019\/07\/10\/emoluments-clause-case-trump-dismissed\/\" target=\"_blank\" rel=\"noreferrer noopener\">failed<\/a>, and the Jan. 6 Committee failed to serve the long-sought indictment that\u2019s become the top item on the Democrats\u2019 policy agenda for six years.
