The court issued an injunction that halted the plan. Last month, the court <a href=\"https:\/\/www.washingtonpost.com\/education\/2022\/11\/14\/appeals-halts-student-loan-forgiveness\/\" target=\"_blank\" rel=\"noopener\">issued<\/a> an administrative stay to the states, but this week <a href=\"https:\/\/www.cnbc.com\/2022\/11\/14\/biden-student-loan-debt-relief-plan-appeals-court-rules.html\" target=\"_blank\" rel=\"noopener\">found<\/a> that at least one state has standing to sue.<\/p>\n<p class=\"p1\">U.S. Solicitor General Elizabeth B. Prelogar told the high court in a <a href=\"https:\/\/docs-cdn-prod.news-engineering.aws.wapo.pub\/publish_document\/7d1b7c7e-5b8b-4ba9-a353-91426075f82a\/published\/7d1b7c7e-5b8b-4ba9-a353-91426075f82a.pdf\" target=\"_blank\" rel=\"noopener\">filing<\/a> that the \u201cEighth Circuit\u2019s erroneous injunction leaves millions of economically vulnerable borrowers in limbo, uncertain about the size of their debt and unable to make financial decisions with an accurate understanding of their future repayment obligations.\u201d<\/p>\n<p class=\"p1\">If the Supreme Court does not get rid of the injunction, Prelogar said it should \u201cset the case for expedited briefing and argument this Term to avoid prolonging this uncertainty for the millions of affected borrowers.\u201d<\/p>\n<p class=\"p1\">Last week, Texas U.S. District Judge Mark Pittman <a href=\"https:\/\/www.dailywire.com\/news\/breaking-federal-court-declares-bidens-student-loan-bailout-is-illegal\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that Biden\u2019s plan is illegal, which essentially made it so that the Education Department could not take in additional applications or dismiss any student debt. The Biden administration <a href=\"https:\/\/www.dailywire.com\/news\/biden-doubles-down-on-student-loan-cancellation-despite-federal-ruling\" target=\"_blank\" rel=\"noopener\">issued<\/a> an appeal to the ruling shortly after Pittman\u2019s ruling.<\/p>\n<p class=\"p1\">The states at the heart of the case that resulted in the injunction claim that Biden\u2019s plan acts in violation of the separations of power and the Administrative Procedure Act, CNN <a href=\"https:\/\/www.cnn.com\/2022\/11\/18\/politics\/student-debt-relief-supreme-court\/index.html\" target=\"_blank\" rel=\"noopener\">reported<\/a>. A district court found that the states would not be successful, but the Eight Circuit reversed the ruling.<\/p>\n<p class=\"p1\">The legality and constitutionality of the student loan forgiveness plan is being questioned. It will <a href=\"https:\/\/www.cnn.com\/2022\/11\/18\/politics\/student-debt-relief-supreme-court\/index.html\" target=\"_blank\" rel=\"noopener\">provide<\/a> up to $10,000 in debt cancellation for qualifying student loan borrowers who earn less than $125,000 as individuals, or earn $250,000 as a household. Those who obtained Pell Grants could have up to $20,000 canceled. The plan is expected to cost American taxpayers more than $400 billion, per <a href=\"https:\/\/www.foxnews.com\/politics\/white-house-ask-supreme-court-rescue-500b-student-debt-handout\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>. The Biden administration has said it will <a href=\"https:\/\/www.ed.gov\/news\/press-releases\/us-department-education-estimate-biden-harris-student-debt-relief-cost-average-30-billion-annually-over-next-decade\" target=\"_blank\" rel=\"noopener\">cost<\/a> around $300 billion.<\/p>\n<p class=\"p1\">The Biden administration contends that it does have the legal authority for its plan due to the 2003 Higher Education Relief Opportunities for Students Act (<a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1412\/text\" target=\"_blank\" rel=\"noopener\">HEROES<\/a>). The law allows the Education Secretary to get rid of or alter student loan debt in times of war and national emergencies for specific individuals.<\/p>\n<p class=\"p1\">According to a <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1412\" target=\"_blank\" rel=\"noopener\">summary<\/a> of the law, such individuals include military service members, people who live or work somewhere that is \u201cdeclared a disaster area \u2026 in connection with a national emergency,\u201d or who have \u201csuffered direct economic hardship as a direct result of a war or other military operation or national emergency.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Biden administration asked the Supreme Court to weigh in on its student loan forgiveness plan on Friday and let the program resume.
