Visek, Acting Legal Adviser, United States Department of State, in a letter. \u201cThe State Department recognizes and allows the immunity of Prime Minister Mohammed bin Salman as a sitting head of government of a foreign state.\u201d<\/p>\n<p>\u201cUnder common law principles of immunity articulated by the Executive Branch in the exercise of its Constitutional authority over foreign affairs and informed by customary international law, Prime Minister bin Salman as a sitting head of government is immune while in office from the jurisdiction of the United States District Court in this suit,\u201d the letter continued. \u201cIn making this immunity determination, the Department of State takes no view on the merits of the present suit and reiterates its unequivocal condemnation of the heinous murder of Jamal Khashoggi.\u201d<\/p>\n<p>The letter concluded by requesting that the U.S. Department of Justice \u201csubmit a suggestion of immunity to the district court.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: Biden administration suggests immunity for MBS in DAWN &#038; Cengiz lawsuit for murder of <a href=\"https:\/\/twitter.com\/hashtag\/JamalKhashoggi?src=hash&#038;ref_src=twsrc%5Etfw\">#JamalKhashoggi<\/a>: <\/p>\n<p>breaking promise for accountability, Biden guarantees MBS impunity. <a href=\"https:\/\/t.co\/72n3dV53Gx\">pic.twitter.com\/72n3dV53Gx<\/a><\/p>\n<p>\u2014 Sarah Leah Whitson (@sarahleah1) <a href=\"https:\/\/twitter.com\/sarahleah1\/status\/1593442376063897601?ref_src=twsrc%5Etfw\">November 18, 2022<\/a><\/p>\n<\/blockquote>\n<p>Biden <a href=\"https:\/\/www.dailywire.com\/news\/biden-fearing-saudi-arabia-wont-penalize-mbs-after-he-promised-during-election-that-he-would-hold-saudi-leaders-accountable-reports\" target=\"_blank\" rel=\"noopener\">said<\/a> in 2019 that he wanted to \u201cmake [Saudi Arabia] pay the price and make them, in fact, the pariah that they are\u201d after U.S. intelligence said in a report that they assessed that MBS \u201capproved an operation in Istanbul, Turkey to capture or kill Saudi journalist Jamal Khashoggi.\u201d<\/p>\n<p>Biden <a href=\"https:\/\/www.dailywire.com\/news\/biden-claims-he-confronted-saudi-crown-prince-over-murder-top-saudi-official-pushes-back\">claimed<\/a> over the summer that he confronted the Saudi Crown Prince when he visited the country to ask them to <a href=\"https:\/\/www.dailywire.com\/news\/biden-admin-claimed-trip-to-saudi-arabia-wasnt-about-oil-new-report-suggests-they-lied\">increase oil production<\/a> but Saudi Arabia pushed back on that claim.<\/p>\n<p>Biden claimed during a press conference that he \u201craised\u201d Khashoggi\u2019s murder \u201cat the top of the meeting, making it clear what I thought of it at the time and what I think of it now.\u201d<\/p>\n<p>\u201cAnd it was exactly \u2014 I was straightforward and direct in discussing it,\u201d he continued. \u201cI made my view crystal clear. I said very straightforwardly: For an American President to be silent on an issue of human rights, is this consistent with \u2014 inconsistent with who we are and who I am?
