The <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/8404\/text\" target=\"_blank\" rel=\"noopener\">RMA<\/a> would make it so that any \u201cperson acting under color of State law\u201d must fully recognize a marriage between two people in another state. It also makes it so that the federal government must recognize marriages if they were valid in the state where the marriage took place.<\/p>\n<p>Greg Baylor, senior counsel with Alliance Defending Freedom, told The Daily Wire that \u201cthe original version of the bill created serious threats to religious liberty. The changes to the bill did virtually nothing to address those threats. The amendments to the bill that purport to protect religious liberty are mere window dressing.\u201d<\/p>\n<p>Baylor said the bill \u201cgives the IRS one more building block in its case to take away the taxes and status of nonprofits that hold traditional views on marriage.\u201d He said it also \u201ccreates a threat to religious social service agencies that work with the government,\u201d and could \u201caffect how religious freedom cases are analyzed more broadly.\u201d<\/p>\n<p>Senator Mitt Romney (R-UT), who voted to advance the bill, said that the current bill did address religious freedom, even as his fellow Utah Republican colleague Senator Mike Lee said he would not.<\/p>\n<p>\u201cThis legislation provides important protections for religious liberty\u2014measures which are particularly important to protect the religious freedoms of our faith-based institutions,\u201d said Romney. \u201cI appreciate the efforts of Senators Baldwin, Collins, and others to address this concern, and heartily support their legislation.\u201d<\/p>\n<p>\u201cWhile I believe in traditional marriage,\u00a0Obergefell is and has been the law of the land upon which LGBTQ individuals have relied. This legislation provides certainty to many LGBTQ Americans, and it signals that Congress\u2014and I\u2014esteem and love all of our fellow Americans equally,\u201d he said.<\/p>\n<p class=\"p1\">Last month, the Religious Freedom Institute <a href=\"https:\/\/religiousfreedominstitute.org\/u-s-senate-prepares-to-vote-on-disastrous-respect-for-marriage-act\/\">issued<\/a> a statement to important senators telling them not to support the legislation. The Religious Freedom Institute has also taken issue with the \u201cunder color of state law\u201d wording, stating it could open up an organization to liability.\u00a0<\/p>\n<p class=\"p1\">But on Monday, a group of bipartisan senators said they had reached an agreement to include more religious freedom protections in the bill.\u00a0Senators Thom Tillis (R-NC), Tammy Baldwin (D-WI), Susan Collins (R-ME), Rob Portman (R-OH), and Kyrsten Sinema (D-AZ) said they had confirmed that the \u201clegislation fully respects and protects Americans\u2019 religious liberties and diverse beliefs, while leaving intact the core mission of the legislation to protect marriage equality.\u201d<\/p>\n<p class=\"p1\">The senators said their amendment \u201c[p]rotects all religious liberty and conscience protections available under the Constitution or Federal law,\u201d and affirms that non-profit religious groups won\u2019t have to provide services for a marriage. It also declares that the legislation \u201cdoes not require or authorize the Federal government to recognize polygamous marriages.\u201d<\/p>\n<p class=\"p1\">They also claimed the amendment makes it so that benefits and rights cannot be taken away if they are not from a marriage. \u201cFor instance, a church, university, or other nonprofit\u2019s eligibility for tax-exempt status is unrelated to marriage, so its status would not be affected by this legislation,\u201d the release stated.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A bill that would codify same-sex marriage protections into law passed a procedural vote with the support of 12 Republican senators on Wednesday, despite concerns that it would infringe on religious freedoms.
