Brian Kemp signed in 2019, was previously blocked by a district court ruling until last summer when the Supreme Court overturned <em>Roe v. Wade<\/em>, which Justice Samuel Alito called \u201cegregiously wrong from the start.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">McBurney said in his <a href=\"https:\/\/www.documentcloud.org\/documents\/23307352-ga-abortion-ruling-111522\">15-page ruling<\/a> that when lawmakers signed the bill, \u201ceverywhere in America, including Georgia, it was unequivocally unconstitutional for governments \u2014 federal, state, or local \u2014 to ban abortions before viability,\u201d adding the state\u2019s law \u201cdid not become the law of Georgia when it was enacted, and it is not the law of Georgia now.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cWhat does this ruling mean?\u201d McBurney wrote. \u201cMost fundamentally, it means that courts \u2014 not legislatures \u2014 define the law,\u201d adding that \u201cif the courts have spoken, clearly and directly, as to what the law is, as to what is and is not constitutional, legislatures and legislators are not at liberty to pass laws contrary to such pronouncements.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">Life News <a href=\"https:\/\/www.lifenews.com\/2022\/11\/15\/georgia-judge-overturns-heartbeat-law-banning-abortions-on-babies-with-beating-hearts\/\">reports<\/a> state attorneys argued the judge should view the abortion ban in light of the\u00a0<em><span data-preserver-spaces=\"true\">Dobbs v. Jackson Women\u2019s Health Organization<\/em><span data-preserver-spaces=\"true\">\u00a0ruling since\u00a0<em><span data-preserver-spaces=\"true\">Roe v. Wade<\/em><span data-preserver-spaces=\"true\">\u00a0no longer applies.<\/p>\n<p><span data-preserver-spaces=\"true\">Andrew Isenhour, a spokesperson for Gov. Kemp, told <a href=\"https:\/\/apnews.com\/article\/abortion-us-supreme-court-health-government-and-politics-atlanta-58ba677dd47afad6d25d9887f17e8763\">The Associated Press<\/a> in a statement that the judge\u2019s ruling placed \u201cthe personal beliefs of a judge over the will of the legislature and people of Georgia.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe state has already filed a notice of appeal, and we will continue to fight for the lives of Georgia\u2019s unborn children,\u201d Isenhour said.<\/p>\n<p><span data-preserver-spaces=\"true\">Kara Richardson, a Georgia attorney general spokeswoman, told <a href=\"https:\/\/www.axios.com\/2022\/11\/15\/judge-strike-down-georgia-abortion-ban\">Axios<\/a> that the state officials would \u201cpursue an immediate appeal and will continue to fulfill our duty to defend the laws of our state in court.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">Noah Brandt, vice president of communications for pro-life non-profit organization Live Action, denounced the judge\u2019s ruling saying the Georgia LIFE Act is constitutional.\u00a0<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe Supreme Court overturned Roe v. Wade through their decision in Dobbs, and therefore, state lawmakers have the constitutional prerogative to completely abolish the horrific scandal of abortion,\u201d Brandt <a href=\"https:\/\/www.liveaction.org\/news\/georgia-life-act-overturned-district-judge\/\">said<\/a>. \u201cThis judge is clearly wrong, and I suspect the ruling will be swiftly corrected by a higher court.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">Monica Simpson, executive director of SisterSong Women of Color Reproductive Justice Collective, the lead plaintiff in the case, celebrated ending the \u201cextreme abortion ban\u201d victory on <a href=\"https:\/\/twitter.com\/monicarsimpson\">Twitter<\/a>.<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cWe will continue to work towards a Georgia in which everyone\u2014including Black women and Queer, trans, and low-income people\u2014has the freedom to decide to have children, to not have children, and to raise the families they have in thriving communities,\u201d Simpson <a href=\"https:\/\/www.aclu.org\/press-releases\/georgia-state-court-blocks-unconstitutional-six-week-abortion-ban\">said<\/a>. \u201cWe will have to keep fighting in Georgia to hold our legislators accountable, but this ruling proves we have the power to keep winning.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Georgia judge overturned a state law Tuesday that bans abortions of unborn children with a heartbeat at six weeks gestational age.
