Clayton County, which bars workplace discrimination on the basis of sexual orientation and \u201cgender identity,\u201d does not apply to the 2010 health care law.<\/p>\n<p>\u201cTitle IX\u2019s ordinary public meaning remains intact until changed by Congress, or perhaps the Supreme Court,\u201d said Kacsmaryk.<\/p>\n<p>The ruling by Kacsmaryk came in a class action lawsuit by two doctors represented by the America First Legal Foundation, alleging HHS misinterpreted Bostock. They sued after the U.S. Department of Health and Human Services said in May 2021 it would interpret Section 1557 of the Affordable Care Act, which prohibits healthcare providers from discriminating on the basis of sex, as extending to sexual orientation and gender identity.<\/p>\n<p>Kacsmaryk said the Supreme Court\u2019s 6-3 finding that Title VII\u2019s prohibition against sex discrimination included gay and trans-identified workers did not warrant the same conclusion under Title IX\u2019s text.<\/p>\n<p>When Congress adopted the Affordable Care Act in 2010 during former President Barack Obama\u2019s tenure, they could have included \u201csexual orientation\u201d or \u201cgender identity\u201d in the text, but \u201cchose not to do so,\u201d said Kacsmaryk.<\/p>\n<p>\u200b\u201dCongress limited Section 1557\u2019s protections to those afforded by other federal statutes \u2013 including Title IX. Because Title IX does not protect \u2018sexual orientation\u2019 or \u2018gender identity\u2019 status, neither does Section 1557,\u201d Kacsmaryk wrote. \u200b<\/p>\n<p>Kacsmaryk has ordered both parties to submit \u201cproposed judgments\u201d within 10 days of his order.<\/p>\n<p>Upon entering office, President Joe Biden signed a sweeping executive order, \u201cPreventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation,\u201d which attempted to reinterpret the prohibition on discrimination based on sex \u2014 which is found in Title IX of the Education Amendments of 1972 \u2014 to include discrimination based on sexual orientation and one\u2019s \u201cgender identity.\u201d<\/p>\n<p>\u201cThe <a href=\"https:\/\/womansplaceuk.org\/2021\/02\/07\/bidens-executive-order\/\" target=\"_blank\" rel=\"noopener\">problems<\/a> with this [Executive Order] arise with its misinterpretation of Bostock and the disregard of biological sex and the sex-based rights of women and girls.\u201d said <a href=\"https:\/\/callieburt.org\/\" target=\"_blank\" rel=\"noopener\">Dr. Callie Burt<\/a>, an Associate Professor at Georgia State University in the Department of CJ and Criminology and Center for Research on Interpersonal Violence (CRIV). \u201cThe Biden administration appears to subscribe to a worldview where gender identity should take precedence over sex.\u201d<\/p>\n<p>\u201cThis interpretation would have significant ramifications for women and girls in education, females incarcerated in federal prisons and detention centres, and the like,\u201d said Burt. \u201cThis would represent the \u2018undoing\u2019 of women\u2019s sex-based rights in favour of gender self-ID.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge in Texas ruled against the Biden administration\u2019s extension of the Affordable Care Act\u2019s discrimination provisions to include gay and trans-identified people.
