The counselor, who invoked a Florida rule allowing her to remain unnamed, claimed in a police report and the school\u2019s suspension letter that she \u201cturned sideways to give a side hug\u201d to the student, who put one arm around her shoulder but \u201creached and grabbed her left breast\u201d with his other hand. In the report, the counselor acknowledges that she removed the student\u2019s hand and walked away.<\/p>\n<p>The boy\u2019s family denies he inappropriately touched the counselor.<\/p>\n<p>Yet police were called to the school on reports of an alleged battery, which the young student now faces, though he hasn\u2019t been charged yet.<\/p>\n<p>Attorneys for the boy\u2019s family say he never touched the counselor\u2019s breast and that the school didn\u2019t properly investigate the incident, suspending him for 10 days even though he insisted he didn\u2019t touch her inappropriately.<\/p>\n<p>\u201cMy grandson has been accused of something and then punished before the facts,\u201d the boy\u2019s grandfather said, according to NBC. \u201cWe will not stand for it.\u201d<\/p>\n<p>The school counselor also claimed in the police report that the boy\u2019s teacher \u2013 who didn\u2019t witness the alleged incident \u2013 tried to discuss it with the 10 year old but that he \u201cbegan to yell\u201d and had to be removed from the classroom. The boy\u2019s family disputes her version of events. An attorney for the boy, Rawsi Williams, told NBC that the counselor initiated the hug.<\/p>\n<p>This week, the boy\u2019s family demanded the school clear the boy\u2019s record and fire the school counselor they say falsely accused him.<\/p>\n<p>\u201cWe will not stand by this and allow him to be accused of something that he did not do,\u201d Ed Hollins, the boy\u2019s grandfather, said during a virtual press conference Monday morning, <a href=\"https:\/\/www.news-journalonline.com\/story\/news\/education\/2022\/11\/14\/volusia-family-hires-attorney-fight-school-groping-allegations-racial-injustice\/10696030002\/?fbclid=IwAR2yyvPjAoF-AnNrWJJ7ROT_M02TIcybtpkZV8QJ26mQQuMfdW0aABALBW0\">according to The Daytona Beach News-Journal<\/a>. \u201cI would not stand for my grandchild or any child to be treated this way by a professional. This is a new way of lynching.\u201d<\/p>\n<p>The family and their attorney has been joined by West Volusia NAACP President Sean King in saying the boy is the latest in a line of non-white students receiving disproportionate and more severe punishment within the Volusia County school system.<\/p>\n<p>\u201cOver the last two years of being president, this is a weekly call that I\u2019m getting with situations of this nature, especially with the Volusia County school system, where our Black and brown kids are put on the wrong end of every situation, and no matter how you confront the issue, it continues to happen,\u201d King said, according to the News-Journal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Florida fourth grader was suspended from elementary school and faces a potential misdemeanor charge of battery after he hugged a school counselor late last month.
