But that\u2019s not a reason to become complacent.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Townhall Managing Editor Spencer Brown analyzed\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/townhall.com\/tipsheet\/spencerbrown\/2022\/11\/10\/former-interior-secretary-ryan-zinke-is-heading-back-to-congress-n2615790\" target=\"_blank\" rel=\"noopener\">here<\/a><span data-preserver-spaces=\"true\">\u00a0and\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/townhall.com\/tipsheet\/spencerbrown\/2022\/11\/10\/what-did-trump-do-with-all-the-save-america-money-n2615732\" target=\"_blank\" rel=\"noopener\">here<\/a><span data-preserver-spaces=\"true\">\u00a0what exactly went wrong last Tuesday. A lot of accountability should be demanded from everyone from the former president to party leadership.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">While Republicans\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.politico.com\/news\/2022\/11\/13\/latino-voters-midterm-elections-republicans-00066618\" target=\"_blank\" rel=\"noopener\">made<\/a><span data-preserver-spaces=\"true\">\u00a0significant strides with non-white voting blocs, those gains couldn\u2019t surpass losses with independent voters who dislike Biden\u2019s policies. It\u2019s also increasingly clear, despite an awful political climate for Democrats, they\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.wsj.com\/articles\/why-independent-voters-broke-for-democrats-in-the-midterms-11668249002\" target=\"_blank\" rel=\"noopener\">aren\u2019t<\/a><span data-preserver-spaces=\"true\">\u00a0fans of former President Donald Trump or candidates too closely associated with him either.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">If Republicans desire to win and go on offense ahead of the 2024 elections, they must put support for freelancing at the forefront.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Too Many in GOP Downplay Democrat War on Freelancing<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">When interviewing and privately speaking with Republican candidates for office this past cycle, I asked a handful of them their thoughts on Biden\u2019s War on Freelancing.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Nobody is asking this important question, so I felt\u2013and still feel\u2013compelled to ask. Why not? This question should be posed.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">A couple, like Senator-elect Eric Schmitt (R\u2013MO),\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.youtube.com\/watch?v=WCLu018K5R4\" target=\"_blank\" rel=\"noopener\">understood<\/a><span data-preserver-spaces=\"true\">\u00a0the threat posed to independent contractors and gig workers. Others I spoke to said it wasn\u2019t important to them or yet on their radar.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">I hope more Republicans study the issue. Otherwise, it\u2019s a lost opportunity for the GOP.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">On the legislative side, some Republicans got complacent and didn\u2019t think the\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.help.senate.gov\/imo\/media\/doc\/PRO%20Act%20Fact%20Sheet%202019%20FINAL1.pdf\" target=\"_blank\" rel=\"noopener\">Protecting the Right to Organize (PRO) Act<\/a><span data-preserver-spaces=\"true\">\u00a0would pass\u2013for now\u2013because three Democratic Senators didn\u2019t lend their names to this monstrosity of a bill. However, had it passed it would have repealed right-to-work, made union membership conditional for employment and would reclassify workers as employees and not independent contractors, for instance. With Democrats expected to hold the Senate and control of the House of Representatives yet to be determined, as of this writing, don\u2019t be shocked if and when the PRO Act is reintroduced again. And don\u2019t be shocked if it potentially gains more traction. Elected Republicans must oppose it.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">On the regulatory side &#8211; through the Labor Department &#8211; the Biden administration could bypass Congress and upend the Fair Labor Standards Act under the proposed\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.federalregister.gov\/documents\/2022\/10\/13\/2022-21454\/employee-or-independent-contractor-classification-under-the-fair-labor-standards-act\" target=\"_blank\" rel=\"noopener\">Employee or Independent Contractor Classification Under the Fair Labor Standards Act<\/a><span data-preserver-spaces=\"true\">\u00a0rule. If enacted, it\u2019ll become harder for workers to prove they\u2019re independent contractors and not default employees.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Thankfully, House Education and Labor Ranking Member Virginia Foxx (R-NC) and Workforce Protections Subcommittee Republican Leader Fred Keller (R-PA) have\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/republicans-edlabor.house.gov\/news\/documentsingle.aspx?DocumentID=408645\" target=\"_blank\" rel=\"noopener\">vowed<\/a><span data-preserver-spaces=\"true\">\u00a0to fight this rule. Small business champions in the Senate, including\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.scott.senate.gov\/issues\/empowering-the-innovation-economy\" target=\"_blank\" rel=\"noopener\">Senator Tim Scott<\/a><span data-preserver-spaces=\"true\">\u00a0(R-SC), are also steadfast supporters of flexible work arrangements and will steer other members in the right direction.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">If GOP Leads on Freelancing, New Voters Will Flock to Them<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">With very few pro-freelance Democratic lawmakers in federal office \u2013 Congressman Henry Cuellar (D-TX), Senators Mark Kelly (D-AZ), Krysten Sinema (D-AZ), Mark Warner (D-VA), and sometimes Joe Manchin (D-WV)\u2014Republicans can seize the moment and be the party that leads on the issue.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Freelancing is bipartisan, but Republicans can go on offense and appeal to center-left and independent-leaning freelancers who feel betrayed by Democrats.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Why? More polls show growing bipartisan opposition to abolishing right-to-work, forced unionization, and to placing limitations on independent contracting. A June 2021 Forbes-Tate poll\u00a0<\/span><a class=\"editor-rtfLink\" href=\"http:\/\/myprivateballot.com\/wp-content\/uploads\/2021\/06\/PRO_Act-National-Survey-Summary-6.28.21.pdf\" target=\"_blank\" rel=\"noopener\">determined<\/a><span data-preserver-spaces=\"true\">:\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u202270% of voters are concerned about the PRO Act abolishing state right-to-work protections, forcing workers to pay union dues, or risk losing their jobs. (68% of Democrats, 65% of Independents, and 74% of Republicans are concerned.)\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u2022 57% of voters (including 47% of Democrats and 69% of Independent voters) believe workers should not be forced to join a union as a condition of employment.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The economic trends increasingly favor freelance work, too.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">By 2028, approximately 90 million workers \u2013 over half the U.S. workforce \u2013 will\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.forbes.com\/sites\/ashleystahl\/2022\/09\/02\/say-goodbye-to-the-9-to-5-how-to-master-the-gig-economy\/?sh=723bd7f035cd\" target=\"_blank\" rel=\"noopener\">partake<\/a><span data-preserver-spaces=\"true\">\u00a0in some form of flexible work. And workers themselves favor independent contracting over traditional employee-employer arrangements.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">A recent Flex Association Worker Survey\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.flexassociation.org\/workersurvey\" target=\"_blank\" rel=\"noopener\">found<\/a><span data-preserver-spaces=\"true\">\u00a0nearly 8 in 10 rideshare drivers\u2013who also fall under freelancing\u2013prefer to be independent contractors and not employees.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Pew Research Center\u2019s \u201cState of the Gig Worker 2021\u201d report similarly\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.pewresearch.org\/internet\/2021\/12\/08\/the-state-of-gig-work-in-2021\/\" target=\"_blank\" rel=\"noopener\">found<\/a><span data-preserver-spaces=\"true\">\u00a0flexible worker self-perceptions and respondent perceptions of freelancers nearly mirrored each other \u2014 with both respondents favoring the independent contractor label over employee one.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Pew\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.pewresearch.org\/internet\/2021\/12\/08\/the-state-of-gig-work-in-2021\/\" target=\"_blank\" rel=\"noopener\">elaborated<\/a><span data-preserver-spaces=\"true\">:\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">This survey asked Americans for their views on this issue \u2013 and a majority (62%) say the most appropriate way to describe ride-hailing drivers is as independent contractors providing a service on behalf of the apps or websites. Smaller shares (35%) say these drivers are best described as employees who work directly for these platforms.\u2026 Gig platform workers\u2019 self-perceptions follow a similar pattern \u2013 65% see themselves as independent contractors, while 28% view themselves as employees.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\"><strong>Conclusion<\/strong><\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Conservatism is not the issue; voters want a Republican Party that follows through with promises to rein in government spending and high taxation.
