Bush appointee; Ralph Erickson, a Trump appointee; and Steven Grasz, another Trump appointee.<\/p>\n<p>They sided with Missouri and five other states that sued Biden and Education Secretary Miguel Cardona after the announcement of the program, alleging it was illegal for the executive branch to enact such widespread loan relief.<\/p>\n<p>Biden administration officials have said that the\u00a0Higher Education Relief Opportunities for Students Act of 2003 grants the authority for the relief, which is expected to cost around $400 billion and apply to tens of millions of Americans.<\/p>\n<p>The appeals court ruling came after\u00a0U.S. District Judge Henry Edward Autrey, a George W. Bush appointee, <a href=\"https:\/\/www.theepochtimes.com\/judge-rejects-challenge-to-biden-administrations-student-debt-relief-program_4811722.html\">rejected<\/a> the states\u2019 suit, finding that they lacked standing to sue on behalf of the\u00a0Missouri Higher Education Loan Authority (MOHELA).<\/p>\n<p>The three circuit judges disagreed, finding that\u00a0MOHELA is effectively an arm of the state of Missouri and even if it was not, the financial impact of the administration\u2019s debt discharge still threatens Missouri because it would affect the state\u2019s\u00a0Lewis and Clark Discovery Fund, a capitol project fund that can support projects at colleges. The fund receives money from MOHELA.<\/p>\n<p>\u201cDue to MOHELA\u2019s financial obligations to the State treasury, the challenged student loan debt cancellation presents a threatened financial harm to the State of Missouri,\u201d the panel said. \u201cConsequently, we conclude Missouri has shown a likely injury in fact that is concrete and particularized, and which is actual or imminent, traceable to the challenged action of the Secretary, and redressable by a favorable decision.\u201d<\/p>\n<p>The new ruling follows a separate appeals court <a href=\"https:\/\/www.theepochtimes.com\/federal-appeals-court-temporarily-halts-bidens-student-loan-relief_4813265.html\">temporarily blocking<\/a> the program and U.S. District Judge Mark Pittman, a Trump appointee, <a href=\"https:\/\/www.theepochtimes.com\/texas-judge-strikes-down-bidens-unconstitutional-student-loan-forgiveness-plan_4855632.html\">finding<\/a> it unconstitutional and vacating it.<\/p>\n<p>After Pittman\u2019s ruling, dated Nov. 8\u2014the same day as the midterm elections\u2014the administration <a href=\"https:\/\/www.theepochtimes.com\/biden-administration-stops-accepting-applications-for-student-loan-forgiveness-program_4857468.html\">stopped accepting<\/a> applications for the program.<\/p>\n<p>\u201cCourts have issued orders blocking our student debt relief program. As a result, at this time, we are not accepting applications,\u201d the program\u2019s webpage states.<\/p>\n<p>Administration lawyers have already appealed that ruling and the government will hold onto information from the 26 million borrowers, including the 16 million who have already been approved for relief, \u201cso it can quickly\u00a0process their relief once we prevail in court,\u201d\u00a0White House press secretary Karine Jean-Pierre said.<\/p>\n<div class=\"author_wrapper\">\n<div class=\"one_author_block round\">\n<div class=\"top_row\">\n\t\t\t\t\t<a href=\"https:\/\/www.theepochtimes.com\/author-zachary-stieber\"><img decoding=\"async\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/10\/WEB_ZacharyStieber-1.jpg\" alt=\"Zachary Stieber\" \/><\/a><\/p>\n<p>Follow<\/p>\n<\/div>\n<p>Zachary Stieber covers U.S. and world news for The Epoch Times.
