As a cynic, it served its purpose. The announcement of the <a href=\"https:\/\/www.businessinsider.com\/student-loan-forgiveness-brought-gen-z-to-polls-midterms-2022-11\" target=\"_blank\" rel=\"noopener\">bailout revved up the youth vote<\/a>, which helped put Democrats over the finishing line in many races.<\/p>\n<p>On Thursday, Judge Mark T. Pittman <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/zgvobwqaapd\/11102022studentloan.pdf\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that \u201cno one can plausibly deny that it was either one of the largest delegations of legislative power to the executive branch, or one of the largest exercises of legislative power without congressional authority in the history of the United States.\u201d<\/p>\n<p>The judge <a href=\"https:\/\/www.dailywire.com\/news\/breaking-federal-court-declares-bidens-student-loan-bailout-is-illegal\" target=\"_blank\" rel=\"noopener\">argued<\/a> three key reasons why it was such an egregious decision.<\/p>\n<p>The first, Pittman noted, is that the law cited by the Department of Education for justification of the bailout \u2014 the HEROES Act \u2014 does not stipulate that it can be applied to student loans.<\/p>\n<p>Pittman wrote, \u201cthe HEROES Act does not mention loan forgiveness. If Congress provided clear congressional authorization for $400 billion in student loan forgiveness via the HEROES Act, it would have mentioned loan forgiveness.\u201d<\/p>\n<p>Per the court\u2019s ruling in <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rules-against-bidens-epa-says-agency-does-not-have-authority-to-regulate-carbon-dioxide-emissions\" target=\"_blank\" rel=\"noopener\"><em>West Virginia v. The Environmental Protection Agency<\/em><\/a>, Congress must give explicit orders to agencies. They don\u2019t have the power to go beyond what\u2019s written by Congress simply because they deem that it would benefit the nation.<\/p>\n<p>The second reason is that the Biden administration attempted to justify the bailout by citing COVID, but didn\u2019t accurately explain why forgiving student debt was essential for addressing hardship because of the pandemic.<\/p>\n<p>Pittman even used Biden\u2019s own words against him on this point.<\/p>\n<p>\u201cThe COVID-19 pandemic was declared a national emergency almost three years ago and declared weeks before the Program by the President as \u2018over,&#8217;\u201d the judge observed. \u201cThus, it is unclear if COVID-19 is still a \u2018national emergency\u2019 under the Act.\u201d<\/p>\n<p>And third, Pittman cited that even the Biden administration suggested that it might not have proper authority on this matter.<\/p>\n<p>\u201c\u2018The agency\u2019s past interpretations of the relevant statute\u2019 is another clue that the Secretary lacks clear congressional authorization for the Program,\u201d Pittman argued.<\/p>\n<p>Consider this, the Biden administration created this program even after the Supreme Court made it explicitly clear in <em>West Virginia\u00a0<\/em>that federal agencies cannot go outside of what Congress has ordered them to do.<\/p>\n<p>It was a plain-as-day ruling at the Supreme Court in June. So, what do the self-proclaimed Defenders of Democracy do after that? Did the party of norms and decency act in accordance with the law?<\/p>\n<p>It would appear not. It barreled right ahead and gave its base what it wanted \u2014 a handout. In turn, polls show that young leftist voters rewarded them in droves.<\/p>\n<p>Yet now, millions of gender degree grads and underwater basket weavers might not even get those tax dollars because the Biden administration announced it would stop the program.<\/p>\n<p>As reported, this decision is <a href=\"https:\/\/www.dailywire.com\/news\/biden-doubles-down-on-student-loan-cancellation-despite-federal-ruling\" target=\"_blank\" rel=\"noopener\">already<\/a> in the process of being appealed by the Biden administration. It could very well wind up at the High Court where it will more like than not decisively lose \u2014 as outlined by Pittman.<\/p>\n<p>For some reason, every single legacy media outlet points out that Pittman is a judge appointed by President Donald J. Trump \u2014 as if that should taint his decision.<\/p>\n<p>Nonetheless, critics ignore his sound reasoning.<\/p>\n<p>\u201cIn this country, we are not ruled by an all-powerful executive with a pen and a phone,\u201d Pittman stated in his conclusion \u2014 a throwback to Obama\u2019s infamous line. \u201cInstead, we are ruled by a Constitution that provides for three distinct and independent branches of government.\u201d<\/p>\n<p>He added that keeping those checks and balances is necessary for the U.S. to survive \u2014 regardless of the moment at hand.<\/p>\n<p>\u201cThe Court is not blind to the current political division in our country,\u201d Pittman said. \u201cBut it is fundamental to the survival of our Republic that the separation of powers as outlined in our Constitution be preserved.\u201d<\/p>\n<p>So, not all is lost.
