She was originally accused of 11 charges, and the jury could not reach a verdict on three of them.<\/p>\n<p><a href=\"https:\/\/www.foxbusiness.com\/lifestyle\/elizabeth-holmes-theranos-silicon-valley-deceit\" target=\"_blank\" rel=\"noopener\"><strong>ELIZABETH HOLMES THERANOS CASE: PROJECTS THAT HAVE SHED LIGHT ON THE SILICON VALLEY DECEIT<\/strong><\/a><\/p>\n<p>Attorneys for Holmes requested a new trial last month after former Theranos lab director and key government witness Dr. Adam Rosendorff showed up at Holmes&#8217; home and spoke with her partner, Billy Evans. (Photo by Justin Sullivan\/Getty Images)<\/span><span> (Photo by Justin Sullivan\/Getty Images \/ Getty Images)<\/span><\/p>\n<\/div>\n<\/div>\n<p>Rosendorff then issued a sworn statement to the court saying he stood by his testimony,<\/p>\n<p>Legal experts previously <a href=\"https:\/\/www.foxbusiness.com\/technology\/elizabeth-holmes-chance-new-trial-slim-despite-hearing-expert-says\" target=\"_blank\" rel=\"noopener\">told FOX Business<\/a> that Holmes&#8217; claims did not warrant a new trial, but that accusations of prosecutorial misconduct are serious and the judge likely wanted to be sure the verdict would hold up on appeal.<\/p>\n<p><a href=\"https:\/\/www.foxbusiness.com\/lifestyle\/theranos-founder-elizabeth-holmes-inside-weird-lifestyle\" target=\"_blank\" rel=\"noopener\"><strong>THERANOS FOUNDER ELIZABETH HOLMES: INSIDE HER WEIRD LIFESTYLE<\/strong><\/a><\/p>\n<p>So, Rosendorff returned to the witness stand for an evidentiary hearing last month, where he reinforced to the court that he stands behind his earlier testimony and denied that it was influenced by prosecutors.\u00a0<\/p>\n<p>Davila noted in his ruling Monday that during the evidentiary hearing, Rosendorff testified &#8220;on at least three occasions&#8221; that &#8220;he did not believe the government was making things sound worse than they were at trial.&#8221;<\/p>\n<div class=\"inline image-ct\">\n<div class=\"m\"><source media=\"(max-width: 767px)\" \/><source media=\"(min-width: 768px) and (max-width: 1023px)\" \/><source media=\"(min-width: 1024px) and (max-width: 1279px)\" \/><source media=\"(min-width: 1280px)\" \/><img decoding=\"async\" src=\"https:\/\/a57.foxnews.com\/static.foxbusiness.com\/foxbusiness.com\/content\/uploads\/2022\/10\/931\/523\/rosendorff-1.jpg?ve=1&#038;tl=1\" alt=\"Adam Rosendorff\" \/><\/div>\n<div class=\"caption\">\n<p><span>Former Theranos lab director Adam Rosendorff (R) arrives at federal court on Oct. 17, 2022, in San Jose, California. Davila previously <a href=\"https:\/\/www.foxbusiness.com\/technology\/former-theranos-executive-sunny-balwani-denied-new-trial\" target=\"_blank\" rel=\"noopener\">denied Balwani&#8217;s request<\/a>, and his sentencing is set for next month.<\/p>\n<p><a href=\"https:\/\/www.foxbusiness.com\/apps-products\" target=\"_blank\" rel=\"noopener\"><strong>GET FOX BUSINESS ON THE GO BY CLICKING HERE<\/strong><\/a><\/p>\n<p>Holmes&#8217; sentencing date is now slated for Nov. 18.
